AMSTERDAM, Netherlands - A Dutch court convicted two men Wednesday for attempting to infect 14 victims with HIV in a bizarre sex case.

The Groningen District Court found the two guilty of severe assault for injecting semiconscious men with HIV-infected blood at sex parties between January 2006 and May 2007.

Peter M., 49, who was also convicted of rape, was sentenced to nine years in prison and Hans J., 39, received a five-year sentence. Under Dutch privacy laws, the surnames of convicted criminals are not released.

"By committing these acts, (Peter M.) has shown himself to have a serious lack of respect for the rights of others," the three-judge panel's written ruling said. "While he knew from his own experience what far-reaching consequences are tied to an infection with HIV, he repeatedly attempted to bring this same hurt to others."

Prosecutors had argued that the two men, along with a third who was acquitted of major charges, had drugged the 14 victims and intentionally infected them.

But in Wednesday's ruling, judges said while the victims all had HIV, it could not be proven that they were infected by the injections because they willingly took part in orgies where gay men had unprotected sex.

The judges also said allegations the victims were given GHB, known as a "date rape" drug, were also unproven.

The suspects were not charged with attempted murder since Dutch courts have held that HIV is a chronic illness rather than an inevitably fatal one.

Actually, I was thinking the same thing.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

It would be the US who would jail the victims for taking part in a involving more than just a Man and a Woman.

At least if you lived in a red state anyway.

Those two things surprised me too. If I was the prosecution, I would have at least tried to find some evidence from their physicians at what stage they were at in their HIV. The individuals whose symptoms were closely linked to having contracted it around that time frame they were injected, I would have put that before the court. If nothing else, possibly increasing the sentence of the accused.

But I think bolded point #2 is why perhaps the prosecution didn't bother perhaps? I'm not sure I don't know anything about courts in the Netherlands. But if there is already judicial framework which considers HIV as a chronic illness and not inevitably fatal, then it may not matter if you show that contracting HIV is giving you essentially a death sentence because its considered a slow decline in function rather than necessarily fatal. Thereby not considered for murder.

Clearly though, these two guys had some serious self-hate going on and wanted others to share in their pain. Really f*cked up!

Oddly enough one of the results of lengthening life and improving the health of those infected

would be the ability of more sexual contacts, leading to wider spread.

A cure would be the real answer.

Until that day arrives, I suggest folks avoid male2male sex and shooting drugs.

20 years later these are still the vast majority of new cases. (though these groups make up a small fraction of the Population as a whole)

High risk hetro sex only accounts for about 15% of new cases, even though many more people are in this group.

(herpes is another story)
