MAY FILER--the VSC Conversation

Okay, so today my husband called the VSC up since we're seeing other cases getting moved to CSC and we're not. After getting in touch with a live operator, i told him to ask for a supervisor or a manager and talk to them what takes the approval so long?

Before we applied for our I129F and I30, we had a K1 visa that was approved last March. But then we decided to get married in my country so we surrendered it along with the letter stating that we'll start the appropriate spousal visa. Last sept. 3, the K1 got expired.

Our NOA1 for the new applications were dated back in May.

Anyway, when hubby was able to talk to the manager, he told him that we got approved last June. Apparently, the State Department wasn't too convinced with our papers that they sent it back to the USCIS for review...and this is where my "What the!!!????" moments begin.

To start with, they didn't touch our petition until July according to the online status (unless they did touch it and didn't update). Since June, if they really weren't convinced with the documents, why didn't they send us any RFE? The manager also told my hubby that they lack manpower and that our case hasn't been assigned to anyone for review yet...Since June????? Their claim of us having been approved just after a month of application blew our minds away, and the other claim that it was sent back made me cry the whole day; and the fact that our paper could have possible been sitting behind their a$$es since June if their claim is true, and without sending us any RFE to strengthen the proof of our marriage is way beyond ridiculous and shows how screwed up the whole system is.

I hope the congress people and the senators that my husband contacted will be able to help us. I will not forgive them for wasting all the time that i could have spent with my husband because of their negligence.

VISA IN HAND: March 6, 2009

HOME: March 7, 2009

FOLLOW UPS:

11.10.08-called up USCIS to inquire about our status/sent faxes to congressmen and senator

11.12.08-called up USCIS again and was told that our case was moved to CSC back in June(!) because the state department have some questions about some of the documents we filed. And they never sent us any RFE...Grrrrrrr!!!! Was told that they don't know what the problem with the documents...Grrrrrr (again)! and was told that they will file a request for review...uuuuuggghhhh!!!!

01.14.09: Hubby sent a Thank you letter to his senator's office for clearing out the confussions with our application last Dec. 4. We'll go with K3...Hubby's doing his ITR as we speak... =)

you are K3 as per your signature. i havent seen any K3s getting transfered. from what we have seen in the past few days, only the stand alone I-130 filers are being transferred.
