Hi there - you've not got any information in your profile about you and your family, and where you are in terms of physical location and stage in the visa process. Makes it harder to answer your question accurately ;)

However, as a general rule, your USC husband can petition for his step-children, as long as they are under 21 and unmarried and you have legal documentation that shows you have full custody and permission from their natural father to move permanently to the US with them. I am having this written into our divorce paperwork, so that it's a court order (you have to declare child custody arrangements in the UK in order to satisfy the courts before they'll grant the divorce).

It means though that your USC husband will have to show the ability to sponsor a family of your size with your kids, and provide adequate accommodation. If you are using co-sponsors, then they need to be able to sponsor all themselves, theiir dependents, you and your children. In my case, my USC other half's mother is acting as co-sponsor. She and her husband have intermingled finances and I have one 9 year old child, so her income needs to be $26,500.00 a year to meet the amount of 125% of the poverty level for a family of 4.

From what I know as long as your marriage to your USC husband took place before your children's 18th birthday he can file for them. This is according to the filing instructions on the I-130 "Petition for Alien Relative" available on the USCIS website

Hopefully someone else can add any info I might be overlooking but I don't think it's a problem.

Thank you all so much guys.. Sorry I am not done with my profile yet as i just signed up for VJ. I am a Green card holder from the Philippines now in Georgia..legally married to a USC. My kids are only below 15 and we been married for more than a year now .

I am enlightened now and i really appreciate all those info you shared to me.

your husband can petition your children as long as you were married before they were 18yo. and also it would be better if you have supporting documents like pictures / a visit in the PH w/ you & your husband together w/ your children

it was actually my cousin's step mom who petitioned her.. they were married before her 18th bday... when she was interviewed they only asked for their Marriage cert and some pictures to prove the existing relationship between the petitioner...

I petioned both of my step kids who are colombian. The process took us less than a year. All they asked at the interview was about the relationship between their father and I , we also needed a letter from the mom while we were in the NVC process.
