When to file fiance petition...

Timeline

I need some advice on when to file my fiance visa. See, I was previously married (or still married). I separated from a previous marriage in 2007. Meet fiance in 2008. Long story short- Ex was a liar, hid money, wouldnt help take are of home, blah, blah, blah. Bad judgement on my part at the time. So I had to step up and get myself and my kids out of the situation (Ex is not the father of my children, thank goodness!). I am a single mother of two kids so I had to wait to file for a divorce when I got most of the money together. I filed in July 2008. :dance: Made payments on the rest, then once paid in full the papers were filed with courts and I had a waiting period. That was up November 10th. I just spoke to my attorney's office and the date to go before judge to sign off on the papers is December 18th. :crying: . I was wanting to file my fiance visa around the 1st of December to get the ball rolling. Do I need to wait until after the 18th to send in my petition? Some have said to go ahead and send in since by the time they get to the petition everything will be done.

You can not sign the K1 papers until you are legally free to marry. So you can not file the K1 until you are finished with your divorce and are legally free to marry as you will need to have your divorce papers for the K1 visa.

Wait until you have the paper.

You need to be able to marry and once you send off your packet, you'll find it difficult to just try and send things in afterwards and will most likely be denied.

Many people have waited years for their divorce to be finalised before they could apply, but it's worth it in the end.

December isn't too far, just make sure you have everything else ready.

exactly and I was in your shoes. My ex fought to divorce me for over a year and when kai came to see me THEN he signed the papers. (because he knew I had moved on and it was OVER for sure..moron DUH LOL)

You can't file for the K1 until your divorce is signed for and then I would not file for about a month or two so there is no hassle..I mean you can file the next day if you wanted to but expect questions and be prepared for it...we are

07/15/08[/font] Sent off I 129F

07/17/08 Arrived and picked up by CSC

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Im sorry guys. Dumb moment. I did have that on my list from the guides that I need to file the divorce papers with the petition. Therefore, cant file until after that date. But as far as how long we were separated and meeting my fiance after the fact. What kind of proof do I need? Can I have family members or others sign something stating they knew we were separated? Someone has suggested that to me before. The attorney put the date of separation as the date I went in and filed the papers (July 2008) since I didnt have a definate date. Im a little worried now. I dont want them thinking that he broke us up when he had nothing to do with my divorce. That would be horrible. And from the stories I have read on here they can be down right mean at the interviews. Any suggestions?

Why do you need proof that your USC had nothing to do with the legal termination of your marriage?! I separated from my husband in May 2002, started filing for divorce, couldn't muster the emotional strength to take it to having him served by Bailiffs, ran out of money to afford it more recently and honestly, why did I need to pay for a divorce when we've been successfully separated for nearly 6 years? After 5 years separation my 'ex' cannot contest the divorce that I'm now seeking in order to be legal allowed to remarry the USC that I've known for 2 years....

What they going to say to couples who are divorcing having met their Mr./Mrs. Right, who just happens to be a USC?

If it were me I would wait until its final and then file my petition. You will know that you are legally divorce and you will not have any problems with your visa process.

Now, who is to say that even if we do that they wont deny us after marrying as well. Is there any hope for this situation? Surely, do they know people just cant always come out of pocket and pay for a divorce right away? That was the only reason it was not done sooner. OMG! :crying:

I am not saying it is hopeless, just be prepared with proof to explain what happened. If they do ask these questions, and you aren't prepared, chances are higher for a denial. If you are prepared the chances reduce greatly.

That would be helpful if that is all you can get, but if you had something more concrete such as proof of a division of housing, financing, utilities, insurances, etc that would be best.
