Hello Members,

Am new in this site and i need your help. Pls..help me and i would appreciate any ideas.

I have 3 minor kids in The Philippines and they were included in my K1 visa when i came here in the USA but i did not bring them with me yet since they'e too young.

I am a LPR now and i want to bring my kids here wi

th me. My question is can my husband file a petition for my minor kids? him being the US citizen? and if so What kind of application we need to apply and Is there any chance that my kids will be approved if filed a petition since they're still below 18?My husband is a citizena and he will sponsor the kids application. Is this correct?Plsss help!

The first step is for your Husband as the USC to file the I-130 for each Child. Make sure to include the marriage and birth certificate in each of the packages that pertain to each Individual child. After the USCIS apporves the petitions they will go to the NVC for processing and interview. It is best if you and or your husband attend the interview. Not sure about the Phillipines but in Columbia it was a plus that my husband went ( I was the petioner for my 2 step Kids ) all question asked were related to my relationship with my husband. You will also neeed to check the requirements of the children being allowed to leave the country. NVC will ask for a letter from the father stating the children are allowed to immigrate to the US.

Once again my story is based on brining my step kids from Colombia, from start to Finish it took around 9 months and we had the holidays and money issues in between.

PS how old are the children?

4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

How long hase it been since your K-1 was issued? Less than 1 yeasr? If so, the kids may still qualify for follow-to-join benefits.

If not, the USC can petition for the kids as long as the stepchild relationship was created before they were 18. A separate I-130 must be submitted for each intended immigrant child.

[Thank you guys so much for your advice.. i do think i have a better view now on what am gonna do? Yes its been more than a year since i had my K1 visa approved. It was my decision not to bring my kids yet since it will be a big adjusment for me and my hubby. I hope they will grant our application since my kids are only 5 and 9 by the time i got married to a USC.We been married for more than a year now and am from the Philippines.

Then your Husband will need to petiton them as he can as the step parent and it will go faster than you applying for them. Good Luck.......
