i think the OP is meaning that her new fiance isnt in america or a cit and wanted to know is SHE can petition him to come here.

Ah, I got it! That's quite a situation. Marry American, become American, leave American, petition for foreign fiancee (who may eventually become an American).

I can see how it may be viewed as fraud, especially, as pushbrk stated, if both parties knew each other prior to coming to America. USCIS would wonder if there was not some plan from the outset.

How could USCIS check whether the new fiancee previously had known the naturalized citizen? Seems like a daunting task, to say the least.

I'll leave it for them to figure out.

The hypothetical pushbrk presented is exactly why scrutiny is so intense at some consulates. The PI has a long, established immigration history with the US, and LOTS of confusing issues including fraud.

thanks to you all.every information counts.appreciate all of it.just for clarification my husband was the one who divorced me last august just a month after i got my citizenship and the effectivity of the termination is February of 2009.I met my now fiancé last September and I'm planning to visit him this January and be with him for a month.is it ok if we mail the package while I'm still there(since the effectivity is feb 2 can we mail the pckage feb3) I'm also planning to come back for his interview so I can accompny him and prove that it's a bonafide relationship.
