I-130 For Step-Children to Come to US (EXPEDITE???)

Hi, any experiences or advice would be very helpful in the following situation regarding me and my wife:

In August we filed her AOS after we were married and planned on filing for her kids who are in Indonesia later next year. Right now they are living with my wifes parents but due to extreme circumstances we now need to bring the kids here to live with us asap. The kids are both under 5 years old and currently are in jeopardy of being harrassed by my wifes ex who has no legal authority or custody of the kids. My wife is here in the US and waiting for green card interview and can't live with the kids at the moment though we plan on visiting in December. My wife is afraid that if the ex finds out she is not with the kids he might try something with the courts and try to jeopardize her custody so now due to these sudden issues of secuirity for the kids, we need to bring them here with us ASAP! My wife has full custody of the kids at the moment and this was given by the courts in Indonesia. The ex has a criminal record and has shown to be incompetent and not rational in the past as he has robbed my ex and her Dad as well as running away with one of the children blackmailing my wife to get back together with him! This was all last year before me and my wife were married here in the US and over the last few weeks after a year disapearance has been showing his face again to my parents-in-law.

My question is to anybody who has had experience or success in expediting a 1-130 visa petition?? We can not wait the 6-9 months estimate of the USCIS and NVC and need any advice on what possibilities we may have?? We have read a couple posts regarding sending a letter to USCIS requesting an expedite but they were very vague and didn't show any success in this matter.

Please help we are desperate and even considered seeing if it was possible for my wife to stay in Canada with the kids if the kids visa procedure could be in actuality sent to Canada. Don't know if this is possible either but of course we would rather just have the case expedited here in the US and requested in Jakarta.

Please any advice anyone has to offer will help!! THANK YOU!!!

Why not? They say security is a reason for expediting. This situation definitely involves the security of the children. So what is a reason for expediting?

If you are convinced you can make a case then submit a request... I am simply telling you what I expect will happen....

The NVC has expedite procedures for applicants/petitioners with life or death medical emergencies. If you wish to request a review for expedite, please submit medical documentation declaring a life or death medical emergency to the NVC.

USCIS Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The criteria are as follows:

* Severe financial loss to company or individual

* Extreme emergent situation

* Humanitarian situation

* Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

* Department of Defense of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

* USCIS error

* Compelling interest of USCIS

If your case is at a local office at the time you need to make your emergency request, please go to the local office in person to make your request. Please be sure to take all supporting documentation with you.

If your case is at one of our Service Centers or the National Benefits Center, please call customer service at 1-800-375-5283 to receive further instructions on where and how to send your request.
