Can I apply for a work permit?

We applied for my I-129F this year and got approved on September. I came up on October with my tourist visa, was given 6 months to stay.

Can I apply for a work permit?

We are still waiting for the consulate to send out my fiance packet, but the way things are going we really need for me to start working asap.

The embassy said that maybe they will have sent my packet by the end of this month, then I can go for my interview, then we can get married. But we are talking about 3 months before we are married. Then I apply for AOS and the work permit takes 3 months more. So this means 6 months before I can legally work.

Can I apply for a work permit now ? That way by February I might be able to work here.

Any ideas?

No, you are not eligible for a work permit as tourist status is not an authorized class. As a tourist you are authorized to visit, not to work and reside.

You can't apply for an EAD (Employment Authorization Document) if you are in the US as a tourist, nor can you work as a tourist. If you work and get caught, they will boot you out and I'm sure that K1 will vanish with it.

It looks like you still need to go though the final stages of the K1. I'd go back home once you get the packet. Setup and attend the medical and collect any and all police reports if needed. Once the medical is done (for me at least) the doctor's office will send the results to the Embassy. You'll be given an appointment to attend the embassy for the for an interview. Once you're done with the interview, they will take your passport and place the K1 Fiancé Visa in it and mail it back to you. You can then use this visa to enter the US.

The K1 Visa is good for a single entry into the US for a period of 6 months from issue date. Once you enter the US, the K1 is used you can't use it again don't leave till AOS is done!! After you get here you are given 90 days in order to marry. Once married within the 90 days, apply for (if needed) an EAD and AOS (Adjustment of Status) otherwise known as the magical Green Card. You can apply after at least 2 weeks for a Social Security card at your local SS Office. Might be best to apply after your married and bring the marriage license with you, save you a second trip!

I'm running from memory here, it's been over 3 years since I've gone through this so I might be a wee bit rusty here and there, I'm sure someone will correct if and where I'm wrong!.. things may be different country to country and with each embassy. Good luck! :D
