Thankyou Cham i thought it was rude too and was a bit put out by the response, but then thought i was maybe overreacting.

The "wait together" response leads me to believe that the op doesnt want to wait and is going to return to China get married file the K3 and live in China together until the visa is approved or denied then return to the USA. Making the process even longer, am i right in thinking that you would have to wait until you recieve the correct paperwork stating that the K1 is indeed cancelled before you refile a different petition. Which would also add time.

So what honestly..I have Not seen my SO for 1.5 years but I am not going to be stupid enough to withdraw my K1 petition JUST because I miss him. If I want to be with him I am sticking to the legal route.

JUST because YOU get married does not guarantee you will get a visa for it. EVEN IN CHINA. Now you are on file and IF you cancel and get married they will know it was fraud; IN TURN will get you jail time.

I realize YOU MISS YOUR SO but we all do, WE are all in the same boat!

THIS IS WHAT HAPPENS WHEN YOU FALL IN LOVE WITH SOMEONE FROM ANOTHER COUNTRY!

If you filed the k1 visa it will be 6 months to 9 months... BUT if you go get married it will 9 times out of 10 BE LONGER

THINK ABOUT IT

If she is WORTH it then she is WORTH THE WAIT and IF your love is THAT strong then this wait for the visa WILL BE WORTH IT. If the love is strong YOU both will with stand this wait. It will go by fast..stay busy. WE all have to go through it if we choose to love someone who is not a US citizen

And then again, the majority of people here (and I am starting to lean towards anywhere in the world, too) assume that OHMYGOD people can live in the US only because any and all other countries in the world are just a piece of s**t and even considering about living there makes you a freak of some sort. Or worse.

What on earth is anyone's problem, here? As far as I understand, the OP wants to cancel his current petition and move to China and just be there. They don't feel like waiting, while being apart, and obviously the OP doesn't think he can live in the US and nowhere but the US. So, what's the problem? His Chinese wife won't feel the awesomeness of the States? Ohmygod, will she survive?!??!?! Eventually, at some point in their life (not our place to even guess or care about, really), they'll maybe apply for whichever visa and go to the States. Or, hey, maybe they'll live happily ever after IN HOLYWOW HORRIBLE ICKY CHINA WHICH HOLYWOW ISN'T THE UNITED STATES OF AMERICA, where everything is just milk and honey and birds and rainbows.

I don't know if I read your profile correctly but, you have been waiting since "October"?

One way to look at it is, it gives you both time to think about it.

I dated my first wife for two years before we married.

I internet dated my second wife for....two years before we married.

First marriage lasted 18 years.

I plan for at least that long for my second.

I'm having trouble understanding why any of the particulars of this are any of our business? The OP asked a question... how does he go about cancelling the petition. He seems to have made his decision. Why does anybody care what that is? Does it effect you?

We all know how difficult this process is. Some people handle it better than others. And, no matter the opinions we might have, we must all understand that GUZ is probably one of the most difficult Consulates to contend with..especially when it comes to the K1. Perhaps the OP is hoping to avoid this additional stress, scrutiny and separation. If he has the means and is ok with moving over there to go about this process differently then who are we to tell him that's not the right choice for him?

ok it seems to me like he is going back to China to get married to then file the k3 visa wait it out while the two of them are together in China, then return to the USA,

I totally agree with you USA is not the only country in the world, Health care for a start off is free here in England, schools are good etc.....

We weighed up the options for both countries and as my SO has a business in the USA decided that USA would be the better option, not because i particulalrly want to live in USA bacause i want to live with my fiance and if it doesnt work out visa wise there then he will come here.

The visa application for us is not about the country we live in but about being together.

The main issue bout the opening post was the length of time it took for the visas, and i just expressed my opinion (or tried to) that cancelling the k1 visa to move wherever he wants to live would ultimately make the whole process longer. And that waiting out with the K1 would probably show a result quicker.

Think carefully before 'cancelling' the K1. You may both desire to spend a period of your lives in the States, at some stage. Will it hurt to see the process through? I waited nearly 2 years to be with my, now, husband...Don't do something in haste that you may regret later.

I agree with Kim, but I don't understand where people are getting the K3 route..

Ok, you win. I just can't handle it. The not knowing. The waiting. The desperate desire for touches... (What am I, a leper??) All I wanted to do was get my girl to the States, marry her, and become a good, football-watching, beer-drinking taxpayer. But I can't stand it anymore. I'm moving back to China, for a life of expatriotism. At least we'll be in control of our destinies, and not you.

He says he's had enough of the immigration and is moving back to China for a life of expatriotism. That says to me that the last thing he's going to do is apply for an even longer visa.

P.S. My real question for you guys out there: Since I plan to go back to China, get married, and do this thing the other way, do I need to formally cancel the K-1? Or is it enough just to ignore it? At some point, I'm concerned that the consulate in China will have two different petitions for the same couple.

I would cancel K1.

Get on a plane go back to China, If Embassy in China ask why you moved back to China, Just answer "Obama", and I am sure they will understand.

I have heard China is neat place to visit and live, so my question is why did you come back to the states and leave your girl.
