Dear USCIS,

Ok, you win. I just can't handle it. The not knowing. The waiting. The desperate desire for touches... (What am I, a leper??) All I wanted to do was get my girl to the States, marry her, and become a good, football-watching, beer-drinking taxpayer. But I can't stand it anymore. I'm moving back to China, for a life of expatriotism. At least we'll be in control of our destinies, and not you.

I know you don't care: this is like writing a nasty letter to the ocean. But you should. Are you not comprised of individuals, individuals with beating hearts and maybe even -- gasp!! -- love lives? I wonder what would happen if every USCIS case officer had a foreign fiance(e), or a relative with one...hmmmm....somehow I think things would move along a lot faster...

I understand there is a backlog. I understand there are real threats of terrorism. But what's with the utter lack of transparency? Why, when there is a branch office right down the road, can I not even schedule a meeting with a representative of my government to discuss my case? Why that...kind of reminds me...of....China! I am so confused... I thought you were a government "of, by and for the people." Anyway...a fond adieu...and I wish the best of luck to all those compatriots out there -- stronger, braver and more patient than I -- that are in your hands.

P.S. My real question for you guys out there: Since I plan to go back to China, get married, and do this thing the other way, do I need to formally cancel the K-1? Or is it enough just to ignore it? At some point, I'm concerned that the consulate in China will have two different petitions for the same couple.

All this waiting around still exists when u get married and file the k3 visa you have already applied for the K1 why give it up to wait around for a different visa. The way i understand it takes even longer for the other visa though i am not exactly sure, my friend applied for a k3 visa and it took over a year for them to be together.

Before cancelling your k1 research the wait times etc for your new application good luck on your journey.

Write the service center referencing the case number and both names, asking them to "withdraw" the I-129F petition. Enjoy your time in China.

Donna-marie, for the most obvious reason of all: We wait TOGETHER instead of 10,000 miles apart not knowing when we'll get to be together!!!! Isn't that obvious from my post?! Pshbrk, thanks for your usual clear-headed and knowledgeable response.

You give no information on how long ago you filed the 129f. In any event, if you follow up on your plan, all it takes is a simple letter to the USCIS (with enough information like your SSN to identify you) to withdraw the petition and politely explain why. It may take as many as three months to get a formal reply, but it will ensure that the question doesn't arise when you try to get her to the U.S. via marriage. We do have a frustrating immigration system in which every action by the USCIS can become a political football, so they are very very careful to dot all the i's and cross all the t's.

Like someone else said, you didn't say how long you have been waiting. Are you deep enough in the process that I could say just hang in there and you would rethink?

I DEFINITELY don't think you should cancel your K1. :no:

Why not just go back to China for about 3 months (if you can) with your sweetheart and wait it out together???

Simply get a street address type mail box. Have your mail sent to you their in China. (USCIS wont forward mail, but a 3rd party will).

Trust me, if you go the K3 or regular I-130 to CR-1 route, you WILL wait longer than the K1 :clock: . For some reason the K1 is usually faster than other routes, however that changes from time to time depending on the service center your at.

Again, don't chunk your petition. Your just throwing away your "place in line". Refiling again as a married couple doesn't make your wait faster and you'll be more pissed off than you already are. PLUS this would most likely put a SERIOUS strain on your marriage....and that's something no couple needs...especially a new couple just starting out together.

No it wasnt obvious to me, and it doesnt look like it was obvious to others either, was just trying to offer my opinion on giving up the k1, never pretended to be an expert on any of this. Was just trying to offer words of encouragement.

Would it not hurt your application regarding A of support if your SO is not in the country?

Level-headed people make a decision about where they will spend their lifetime based upon where they feel their lives will be most productive; where they will be happiest; where their children will receive the best education; where they feel they will have the most opportunities; where family is; where thy enjoy the climate the most; where the social infrastructure most appeals to them, etc.

Making a decision to relocate based upon present separations only is a dangerous mistake.

I find your response RUDE how was SHE suppose to know..honestly I swear SIGH

So what honestly..I have Not seen my SO for 1.5 years but I am not going to be stupid enough to withdraw my K1 petition JUST because I miss him. If I want to be with him I am sticking to the legal route.

JUST because YOU get married does not guarantee you will get a visa for it. EVEN IN CHINA. Now you are on file and IF you cancel and get married they will know it was fraud; IN TURN will get you jail time.

I realize YOU MISS YOUR SO but we all do, WE are all in the same boat!

THIS IS WHAT HAPPENS WHEN YOU FALL IN LOVE WITH SOMEONE FROM ANOTHER COUNTRY!

If you filed the k1 visa it will be 6 months to 9 months... BUT if you go get married it will 9 times out of 10 BE LONGER

THINK ABOUT IT

If she is WORTH it then she is WORTH THE WAIT and IF your love is THAT strong then this wait for the visa WILL BE WORTH IT. If the love is strong YOU both will with stand this wait. It will go by fast..stay busy. WE all have to go through it if we choose to love someone who is not a US citizen

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!
