NVC DOESN´T BELIEVE ON THE VERACITY OF MY DOCUMENTS

HOHO you will be OK. We K3'd through the Jakarta embassy with only copies of everything submitted. The ONE thing that my wife did was get her passport modified with her new name at the Immigration office in Jakarta before she applied for the visa , so the visa and subsequent documents (EAD/Green Card/SS card) were all issued in her married name (my last name) per the passport modification. I think the cost was like 30 bucks at the immigration office.

Some things they REQUIRE originals of from the issuing sources. A notary saying they are exact copies of originals will not do on some things.

if they require ORIGINALS only then why don't they just say it then... it says originals OR certified copy.... :wacko:

I'm at this stage myself... I'm guessing that Embassy notarized copies are OK.... thats what I'm shooting for; of course it's more possible since my spouse lives in city where embassy is located.

Well, it seems unbelievable!

This am I called local Notary Public where I authenticated the photocopies of my documents, and explaned the whole situation. They explanned to me that CERTIFIED COPIES means the ones that, besides authenticate by the Notary, were confirmed and stamped by the embassy.

So, I called the embassy and explanned again, and, surprisinly, they said AUTHENTICATED COPIES WERE THE SAME AS CERTIFIED COPIES. So I wasn´t gonna have a problem what the documents at NVC.

Then, I called NVC, explanned the situations, and they remained saying we didn´t subbmited the proper documents... and they need the ORIGINAL OR THE CERTIFIED COPIES...

What the Hell....

So, my attorney insisted on writting a letter to them as I said, but just in case, tomorrow I will go over the US Embassy and get this "special" stamp which seems to be another type of certification or legalization or validation of my docs and then, FedEx them to my attorney.

The only one thing is, I can´t wait one more week until they call me again with this NEW INSTRUCTION which wasn´t in any guideline so far.

And, they do appear to meet the informations, payxibica. I went to the right offices and made sure to get the proper documents for IMMIGRATION VISA.. and they confirmed.

Here is what the NVC letter says:

BIRTH and MARRIAGE Certificates: "the document submmited is not an original or certified copy of an original issued by the appropriate govern authority. The document must be an original, or a certified copy of the original, bearing the original seal or stamp from the issuing authority.

BRAZIL POLICE CERTIFICATE: they basically say I didn´t provide neither from the national police nor State Police.

My attorney believes it was a mistake and guessing whoever reviewed this at the NVC did not look carefully at the docs. She will mail them back point out in a cover letter.

IT IS SO STRESSING....

Essentially, a Notary Public can verify a signature that they have witnessed. A Notary Public can not certify or authenticate a document or copy.

Likewise, an Embassy employee or Consular Officer, can not authenticate or certify a document that they did not issue.

Your BC and MC need to either be originals or copies certified by the same people that issue them.

You can not make a copy yourself, and have someone stamp, sign or otherwise validate the document.

Your lawyer should know this....s/he can write as many cover letters as s/he wants, but that won't make them accept your documents.

You are now slowing your case down.

Ok, So, It will be easy to get an original of Marriage Certificate, but as I was born in a different state, I will have trouble to get it. So, as an emergency decision, I will Fedex my originals, plus certified copies from the Embassy altogether....

and so, get over that....at last...

This is correct and dont worry about the originals because you will get them back at the interview. As a matter of fact they give them back to you before your interview.

In the US a certified copy means a close duplicate of the original with the book and page number stated from extraction. A certified copy in the US must come from the issueing authority. In Brasil things are done differently. If you take note of the notary seal from the registry office it is identical to the seals and authentical obtained from other otaries. Thus, you can not tell the difference. Furthermore, if you have a copy of a certificate notarized and authenticated by a notary in Brasil I believe they require the original in hand to verify. Thus you have a certified copy...identical to one that would be recieved from the civil registry office.

Hi, guys!

Wanna be more stressed...! So, I went over to the embassy today, and guess what! THEY ARE NOT PROCEDURE CONSULAR SERVICES WITHOUT AN APPOINTMENT.... So, I had to go back home, and schedule an appointment. Now I am waiting for them to tell me WHEN....

I was wondering last night, how come USCIS accepted my authenticated copies of Birth and Marriage Certificates for I-130, and NVC can´t accept them now....

I want to thank you for this post. My petition was approved and I thought that I had all of the documents that I needed from my husband. But I noticed that his birth certificate was a "notarized" copy. In his case as well, the Justice of the Peace stamped that this was a true copy of the original. I'm having him send me his Original and request another from Registry (just to be on the safe side)

The terminology used is a little confusing because "Certified Copy" means different things to different people.

At the time of submitting the I-130, photocopies of birth and marriage certificates are accepted, which is probably why they accepted the certified copies at that time. It's not until the NVC that they ask for originals.

Are you able to submit the Original that was used to obtain the certified copy that you have?

But, since I can´t solve this right away at the Embassy, I am working on get this birth certificate anyways....

And, I will be mailing the original by the end of nex week... I think.

I got the same EXACT message two weeks ago for my mother's case and my lawyer instructed me to send them the ORIGINAL documents (both of our birth certificates, police certificates, etc.). Within 4 days of mailing the ORIGINAL documents I called the NVC and they let me know that the case has gone to the Embassy in Rio to schedule an interview. What they mean by original or certified copy is obviously the original document or the copy of the document issued by the official agency (ex. the state of NY would have to issue another b-certificate in my case). You can send the original and they'll have it ready for you at the interview. Don't waste your time trying to argue with them. They want the original documents and that's it, granted that they could word it better. They'll process everything very quickly as soon as they get the originals.

oh well a day late.. had her scramble around to get stamped/seal duplicates where applicable.

She wants to do the name change thing before coming... should that be done NOW? will that delay things??

since javanese don't use surnames its really a name add than it is a name change, though I filled in her "middle" name as a surname, even though it's not.

I got the same EXACT message two weeks ago for my mother's case and my lawyer instructed me to send them the ORIGINAL documents (both of our birth certificates, police certificates, etc.). Within 4 days of mailing the ORIGINAL documents I called the NVC and they let me know that the case has gone to the Embassy in Rio to schedule an interview. What they mean by original or certified copy is obviously the original document or the copy of the document issued by the official agency (ex. the state of NY would have to issue another b-certificate in my case). You can send the original and they'll have it ready for you at the interview. Don't waste your time trying to argue with them. They want the original documents and that's it, granted that they could word it better. They'll process everything very quickly as soon as they get the originals.

Well, my attorney insists in mailing the letter, and I am insisting to mail the originals... So, while I get the Birth and MArriagae certificates, we will be waiting for NVC reply....and since the attorney is mailing tomorrow, NVC feedback about it will be around friday next week... by there, I guess I will get my original docs... and the journey will go on.

Ary,

If you have the original documents, go with your gut feeling and send them in, your attorney should know better. Sending a letter or trying to argue with them isn't going to help you, but rather slow you down. As soon as I received the letter my attorney told me to send the originals and now we're waiting for the interview date.

FINNALY LESS STRESSED, TODAY I GOT NVC CASE COMPLETED, AND I DIDNT NEED TO MAIL THE ORIGINAL. AS I SAID, MY ATTORNEY JUST WROTE A LETTER EXPLANNING THE SITUATION AND HIGHLIGHTIHGN THE POINTS, SO, IT WORKOUT AT LAST.

I AM SO GLAD I WILL GET AN INTERVIEW DATE VERY SOON, AND AS AN ADVISE AFTER MY PROBLEMS WITH THE CERTIFIED COPIES, I WOULD SUGGEST TO ALWAYS SEND THE ORIGINALS, INSTEAD OF CERTIFIED COPIES. JUST TO AVOID A PROBLEM LIKLE MINE THAT MADE MY CASE EVEN MORE SLOW.
