Quick question about I 864

My wife and I are trying to move back to the states. I am a USC, my wife is British.

My whole long story is here. Briefly, however, we got married in 1995 and lived in the states until Jan 2002, where we moved back to the UK.

I have lived and worked here for almost 7 years straight. Obviously, we are looking to do a DCF through the London Embassy.

However, I've noticed on the i-864 (affidavit of support), there is a lot about Federal Tax Returns. I haven't filed a Tax return since 2003, because I didn't think I needed to, since I wasn't earning any income in the US.

Did I need to? Did I get that wrong? How much will this hurt our application if I haven't filed?

25 Nov 2008 - Sent I-130 to London USCIS office

01 Dec 2008 - I-130 received by Embassy

19 Dec 2008 - Petition Approved

24 Dec 2008 - Notice of approval received

03 Jan 2009 - Packet 3 received

03 Feb 2009 - Medical Exam completed

15 May 2009 - INTERVIEW!

18 May 2009 - Interview went well, but Visa not granted. More paperwork to submit, more hoops to jump through

01 June 2009 - Sent in required paperwork Part 2

18 June 2009 - VISA GRANTED!!! WOO HOOO!!!

Yes, you were required to file even though much or all of the income will be excluded. You can still file late.

05/02/2007 Driver's License - Passed Road Test!

05/27/2008 Lifting of Conditions sent (TSC > VSC)

06/03/2008 Check Cleared

07/08/2008 INFOPASS (I-551 stamp)

07/08/2008 Driver's License renewed

04/20/2009 Lifting of Conditions approved

04/28/2009 Card received in the mail

You'll need to file at least the last three years. The IRS has an office at the US Embassy in London, http://london.usembassy.gov/irs/index.htm

FWIW, I've always found them to be very helpful, and I strongly doubt that you're the first person in this situation that they'll have seen. I'd read up on the link above, then give them a call or pop in for a visit.
