Hi

My mom who is a permanant resident is outside of U.S. since February. She had to stay there for 4 months because of her medical conditions then me and my family were visiting her. She intends to come back here in Dec. or January.

I heard she may have hard time at POE.

Is there really something to worry about in this situation?

What are the rules with regards to this situations?

Is some one here who knows of a similar situation?

what proofs should she bring with her to show why she had to stay away?

For stays outside the US for one year, but less than 2 years a re-entry permit may be required. Otherwise she should be OK. :thumbs:

they might give her a hard time, but she shouldn't need a re-entry permit if she's only been gone 6 months. Does she have a 10 year card, or 2 year conditional?

My aunt went through this constantly and almost every time she stayed outside the US for more than 6 months, there was an officer who would question her to no end but was never denied re-entry since it was less than 12 months. Others didn't have any problem with it and let her through without any issues.

Your mom should be ok but it would be a good idea to at least bring a letter from her doctor explaining why she had to stay outside of the US for more than 6 months... just in case.

hello ae4ever,

I am a 2 yrs. conditional green card holder (K1)and went on vacation in the Philippines for 5. 5 months and never had a problem with immigration getting back to US. As long as you don't stay for more than a year then you should be fine and don't need any re entry permit. I hope i have helped you.
