co_sponser for my husband

I married my husband in Turkey back in febuary. I lived there for 2 months with him and then came back to the usa to go to work and try to bring him over. I was under the wrong assumption because I thought as long as I had a good job I wouldnt have a problem getting his visa. My problem is that the form wants me to send in tax records for the last 3 years and I dont have any. I have one from last year, but not the previous years. I know about the co-sponser deal..but I cannot find anyone that is willing to co-sponser my husband. I asked my family as well as my friends...but everyone is too afraid they will have a financial burden if things didnt work out. I got one piece of advice from one member , that told me that I was just out of luck..I want to know if that is so.....I make decent money at my job..and no I am not rich..look guys I love my country..but it looks like I have to chooce between the country I love or the man I love..and I am choosing him...If any one knows if there is another way around this besides working here for the next 3 years to show my income tax records I would love to hear it. At this point I feel my best bet is just to go back to Turkey and plan on spending my life there. I am really hopeless here...because I dont want to be away from my husband for the next 3 years.

I am really sorry for this situation you are at right now !

But I want you to do something call Ankara Embassy and ask them if they will need the last 3 year tax return or last year tax return only..because this is what American Embassy in Cairo asked me too they only asked for tax reurn o fthe last year only ..so before you give in just try to find a way out and I really hope they will need you tax retun of the last year only and you will be able to do it and be with the man you love and still have your job in USA and your life there..

Do you not have any because you didn't work or because you lost them? If you lost them you can get copies sent to you. Maybe I have misunderstood but I'm not sure if you didn't work or what.

When we got the initial package from the NZ Embassy that contained tons of instructions, forms, etc. the Embassy instruction sheet for the Affidavit of Support I-864 requested three years of tax transcripts. However, when we filed the I-130 petition and DS-230 Immigrant Visa Application and were given the interview letter and another instruction sheet, it only asks for one year tax transcript, 2005. Also, you may have a reason for not having the other two years that would be acceptable to the Embassy as you have a good job and current income that can be documented.

Looking on the Ankara Turkey Embassy website, they allow contact by email for questions about Immigrant Visas. I would email them and ask if they now require only the latest year's tax transcript.

There is different requirements for the I-864 then there is for the I-134. Whilst now only one year is required for the I-864 which is for those filing for a CR-1 visa....the I-134 has no such requirements. The I-134 for K visa is used only to assist the conof conducting the interview in part, that the applicant wont become a public charge. Other evidence such as tax returns etc are in addition to the I-134 not a requirement of. The I-134 is also not legally enforceable where the I-864 is.

Present income is more important then past. Have a read around of the pinned threads in various forums and also past threads on this issue by using the advanced search function. If you still need questions answered, post in the Foreign Embassy Forum where there are many I-134 questions asked.

Definately look into this more as others have said before you make such a decision. I would call the embassy in Ankara . There have been many times I have done so myself, since my wife is from Turkey. (I am actually leaving for Istanbul tommorrow to see her )

The embassy has been pretty helpful and patient with me when I have asked them questions. If you are in the USA, you could use a "calling card" (Nobel is the card company I use) to call them from here.

(The only hard part is getting up at 4:30 in the morning , eastern time, to do it )

You have not provided some pertinent items of information - among them, why you don't have past tax records.

In general, one must have sufficient financial resources - current income or assets - to sponsor an immigrant, and the income should be sustainable. Past history may be an indication of sustainability, which is why they ask for past tax records. [edited after reading aussiewench's fine question]

In summary, you may not be in such bad shape as you think you are.

Is this for K-3 visa (as in this forum posted to and in your profile) or is it for the CR-1?

either K3 or CR1, if the petitioner does not have tax returns from previous years because they were a student and didn't have to file them, then no worries. Just show evidence of WHY you did not file tax returns, and show them what you DO have. As long as you have the 125% of poverty guidelines with your current income, you should be fine. Others here have done that.

If however you don't have previous years tax returns just because you couldn't be arsed to file them, then you'd better just go ahead and file back taxes now.
