We filed for AOS back in mid-June, and received the RFE for my wife's (the USC'S) 2007 W2s on Friday. She's self-employed and doesn't have any.

Without going the tax transcript route, and seeing as it's been impossible to speak with anyone at USCIS all day, does anyone have any advice on what type of note to submit to them stating "hey, she's self-employed...she doesn't have W2s"?

We're looking at a five-month process so far...getting a little frustrated on this end!

Then go the transcript route as they take but about 10 days to receive

I ordered transcripts, they arrived 3 days after ordering them.

Most report that a week is the longest it takes to get SIMPLE IRS transcripts.

http://www.irs.gov/faqs/faq1-6.html (Just pick up the phone and dial (800) 829-1040 and order them NO 4506-T needed to be filed)

I faxed Form 4506-T to Austin and had mine in 3-4 days. (I see your from Texas. Fax numbers are in instructions to Form)

Also this is in the instructions:

If you checked box 22( B ) (self-employed), you should havecompleted one of the following forms with your Federal income tax return: Schedule C (Profit or Loss from Business), Schedule D (Capital Gains), Schedule E (Supplemental Income or Loss) or Schedule F (Profit or Loss from Farming). You must include each and every Form 1040 Schedule, if any, that you filed with your Federal tax return.

Did you remember to send Sch C along with the 1040? Maybe that's what's missing.

You should submit the same supporting documents you did with the income tax return be that sch.C, 1099's etc. if you haven't already done so.

If all else fails - as others have suggested - the tax transcripts are the trump card and don't take that long to get.

You will be much better off ordering the IRS transcript. It's okay that she's self-employed and doesn't have any W-2s. Once the case processing resumes, your case will move forward, I am sure!
