Immigrant Visa & Visa Waiver Question

Timeline

Hi all - i've got a "2nd interview" on Thursday at the US Embassy in London on Thursday (see my previous thread - http://www.visajourney.com/forums/index.php?showtopic=160221 for info)..

I've been reading some more, and am I correct in thinking that if I get declined for an immigrant visa, I would then be ineligible to travel to the US on the Visa Waiver Program?

I emailed the consulate last week, but have not received a reply (although wasn't really expecting one)...

If this is correct, how long does it take to get a non-immigrant visa for visiting purposes?

Q: When Must I Obtain a Visa Instead of Using the VWP?

A: If you intend to arrive in the United States aboard a non-signatory air carrier, you must obtain a nonimmigrant visa prior to boarding the aircraft. Similarly, if you intend to visit the United States for more than 90 days, you must obtain a nonimmigrant visa before arriving in the United States. If you believe any grounds of inadmissibility at INA § 212(a) apply to you, you should apply for a nonimmigrant visa with Form OF-156 before traveling to the United States. You can obtain Form OF-156 from the American Embassy or consulate nearest your place of residence or the State Department Website. Although you may be inadmissible to the United States, you may qualify for a nonimmigrant visa and waiver, which will allow you to travel to the United States.

That is really ridiculous that they haven't replied. What a pain this has all been and what a shame you're having to worry about problems like having to get a non-immigrant visa.

Since you didn't sign the DS-230 Part 2 and since at the first interview they acted like everything was fine, I really cannot imagine that there is any problem beyond them needing you to sign the DS-230 Part 2 in front of them.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Thanks MargotDarko (and YuandDan!)...

I'm obviously just anxious that there is something else thats gonna come out of leftfield that i'm not expecting; I certainly dont have a communicable disease, and as i've said before the consular officer said everything was in order... Goodness knows - i've scoured the net and i've never heard of a CO missing the fact i needed to sign the DS-230 Pt 2 before.. but knowing me, i'll be the 1st!

I was thinking though, after this is all over, i'm going to write a comprehensive post detailing what i've been through from start to finish, to help other DCF'ers here.. I think with this recent event, i've already come across 2 occasions that are quite unique so i hope it will help others throughout this process.

I'll post again on Friday, once this is all settled - wish me luck!! :)
