I AM ABOUT TO FILE FOR A K-3 FOR MY WIFE. WE HAVE BEEN LIVING TOGETHER FOR 4 YEARS IN MEXICO AND HAVE 2 CHILDREN THAT WERE BORN HERE BUT HAVE DUAL CITIZENSHIP. I HAVE A JOB OFFER IN MICHIGAN. I AM CONSIDERING TAKING THE JOB HOWEVER I CANNOT GO 6 MONTHS TO A YEAR WITHOUT SEEING MY WIFE AND KIDS. MY QUESTION IS IF I MOVE TO MICHIGAN AHEAD OF MY FAMILY IS IT POSSIBLE FOR MY WIFE TO VISIT THE STATES WHILE THE K-3 IS IN PROCESS? IF SO HOW LONG CAN SHE STAY FOR? ANY HELP APPRECIATED THIS WHOLE PROCESS SEEMS PRETTY INTIMIDATING. THANKS...

Yes, she can visit you. She will have to show strong ties to her home country and indicate that she has intent to leave the US and not try and adjust status while visiting on a tourist visa (since that is against the law).

As for how long she can stay, that is up to the customs officer when she travels to visit you.

The maximum length of stay is usually indicated on the visa. Usually, it's 90 days but there's no guarantee of entry or length of stay. The worst case is you do the visiting. No need to go six months without seeing your wife and kids. You have lots of options.

I would find out whether or not you're able to directly file the I-130 petition in Mexico before leaving, especially if you don't have to start the job asap.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
