I am not sure what answer he would give when asked what he will be doing over next 2 years.

CR1 is only good for 2 years?

At what point do you have to file?

I am just confused what is difference between AOS and EAD?

My husband SHOULD be getting his greencard either the day he comes OR in the mail...

just not sure what steps he takes once he is actually here on CR1

CR1 is only good for 2 years? CR1 is good for one entry... The eventual first greencard is good for two years

At what point do you have to file? file what? Removal of conditions? If so, 90 days prior to the expiration of the greencard

I am just confused what is difference between AOS and EAD? Does not apply to you so you need to concern yourself about. AOS and EAD are interim benefits for those adjusting from non-immigrant to permanent resident status

I think you already got the answers you were looking for and I put a long post to your other question about Philly as a POE in the "life in America" forum (your post was moved)

They never asked Jihed about what he would be doing for the next 2 years. But I suppose should they ask the answer would be living with his wife, building a family, working, etc. Again, I don't think that question is asked?

CR 1 is the type of visa for couples married under 2 years and through this your husband will receive his 2 year conditional green card. The green card will come to you in the mail and you don't have to do anything to get it. Jihed's arrived about 3 weeks after he got here. He received a letter from the Texas Service Center that said welcome to America and that they had received his file from Philadelphia immigration. The letter stated that the green card should follow with in 7-14 business days.

The green card that he will receive is conditional for 2 years. In 2 years you have to go through AOS (adjustment of status) I think that most people have interviews for this, but I've seen some get lucky and just get the 10 year green card in the mail. There is a fee and application for this but you will not have to worry about it for 2 years- It's actually 90 days from the 2 year mark. Like Jihed entered on May 18, 2008 so his 2 year anniversary date is May 18, 2010 but we will fill out the application and mail it out in March 2010.

The difference between AOS and EAD - AOS is adjustment of status. Those who came on fiance visas have to go through AOS after they get married and EAD pertains to working. You won't have to worry about either of these, as he's entering on the CR 1 visa not a fiance visa. The only thing that you have to worry about is AOS in 2 years to change his 2 year conditional green card to a 10 year green card. There is a forum for this also. But for now I'd just enjoy your time together. PS See the info below about getting his social security card. Since he's CR 1 he is authorized to work from the day he enters the country and the visa with the stamp from Philadelphia airport is going to serve as his temp green card until the actual card arrives to you in the mail. Once he has this and his social security card he's okay to work. If he wants to work before he has the green card/social it is legal, but a lot of employers are not aware of immigration / employment laws and it can be troublesome to get him hired and payroll processed before he has those two documents.

Again the green card is not given to him on the day he comes. Immigration at Philadelphia (or any airport ) does not have this information with them. Their job is to take his brown medical envelope, finger print him, maybe photograph him, ask a few questions, stamp the visa in his passport and send him out the door to your arms. The green card WILL come in the mail from the Texas service center. If a month passes and you have not gotten the Welcome to America letter and/or the green card, call NVC or Texas Service Center.

After he arrives and you've taken a few weeks or months to adjust there are things you could start doing to prepare yourself for the 2 year AOS. They might include adding him to your bank account or getting him his own bank account, adding his name to your lease/mortgage, utility bills, getting him a driver's license, things like this. When you go for the 2 year interview your job is to show that you've established your lives together and that you have a continuing legit marriage, etc.

Comments : Customs at Philly were REALLY super great! Very friendly, no harassment, took the envelope from the embassy, finger prints and he was on his way!! Overall less than 30 minutes! (and 15 of those spent waiting) Asked him over and over.. What are you going to do in 2 years less 90 days??? And they wanted the answer file to lift conditions LOL

There were really super nice to him. And like I said in the review overall it was about 30 minutes (this was on a busy Sunday afternoon) and most of that time was just spent waiting in line. Prepare hubby to be fingerprinted, make sure he has his big medical envelope. be sure that he knows your address (which will be his address here) and your phone number. Also make sure he knows / understands what he's going to be doing in 2 years from his date of entry - adjusting status / file to life conditions. (since he is coming on a CR 1) Bring some things for yourself to do though in that huge room where you are going to wait (international arrivals) there isn't much there but some chairs and big leather circle seating. I'd bring drinks/food for yourself (maybe him too, Jihed was super thirsty ) and know where the bathrooms are cuz that was the first thing Jihed wanted lol. Now this is just the immigration portion but add more time because of all the lining up to que, separate (citizen / non citizen) getting off the plane, finding baggage, etc. The big board is pretty accurate and up do date when plans are late or sitting on the runway waiting to 'park' so you will probably be in the loop. For safety sake I bought Jihed a Us calling card, he printed it out (online / with the pin number) and made sure he knew how to dial my cell phone w/ the card incase he found any problems before he got out to me (did this before he left Tunis) I went over his flights with him - he had a connector in Frankfurt Germany, etc. Go to the Philadelphia air port website http://www.phl.org/index.html find your airline and it tells you the best / closest place to park, fees for parking, and even has a time table for the flights - reporting on the day of his arrival if his flight is going to be late/early, etc and you can plan your departure from home around that (what I did) . I was glad that I parked close because he was super exhausted and you know how busy Philly is so navigating the parking and terminals can be a bear. It's better to map it out ahead and know what's going to happen/ where to go. If you want to know anything else, please don't hesitate to ask here or PM me and I will try to help in any way possible. PS With the CR 1 here, immigration will take that brown envelope, within a few days they will send it to the Texas Service Center and you should get (he will get, addressed to him) a letter saying Welcome to America and your information was received and Green Card will be generated. It took exactly 3 weeks for Jihed to get his green card in the mail. If you checked the box on the application (CR 1) to have the social security card sent directly to your home, you may find problems with that. We waited and waited and it NEVER came. I called and SS had no record of an app for him. So we went down to the local office, applied, (www.ssa.gov - you can get the forms) and it came in about 8 days. I suggest this is best. I wouldn't even wait to see if the card comes, just go right down after you print the application for a social security card online, show his passport (with the visa in it) and you should be good to go. biggrin.gif

The OP does not have to worry about Adjustment of Status (AOS) but Removing Conditions.... AOS is the I-485 and Removing Conditions is the I-751. Important difference!
