I have a question regarding the ds156 form, question #36. It says:

Has anyone ever filed an immigrant visa on your behalf?

This is confusing b/c some people think of a K1 visa as a non-immigrant visa. In this case, no one has, but if you consider a K1 visa an immigrant visa, then the answer is yes.

Any help would be great. Thanks!

There is an EXAMPLE DS-156 that you can use as a ref, we did and had no problem.

Tends to be YES for K-3 but NO for K-1

NOTE K-Visas are hybrid they are NON-Immigrant but have Immigrant intent, so require a petition to be filed by a US citizen, and are processed by the immigrant visa unit at the consulate.

sorry to resurect this thread but, the question i see is imigrant visa petition?

is it still yes for k3 and no for k1? or would my fiances petition for my k1 count as yes? :unsure:
