K-1 Best Option?

Sorry if this has been asked before or if it's in the FAQs. I've been looking but I haven't seen an answer yet, so I thought I'd just start a new topic.

Without getting into a really long explanation, my fiance and I really want to get married next year so that I can move to LA and live with him. However, we're both just finished college so we haven't been working fulltime and so he doesn't have massive savings or tax credits or any of that financial stuff. Even though we have a sponsor, we have been told that we could be denied a K-1 because we're so young and 'technically' don't have money. (side note; we do actually have fulltime jobs now and we're saving up like crazy for the visas and stuff)

So we were wondering which would be more advisable;

- apply for the K-1 and hope for the best, OR

- marry him while I'm visiting, then come home and apply for a visa based on the fact that I'm his wife.

I know it's illegal to marry for the purposes of staying there, which of course I'm not going to do. I have every intention of coming home when my 90 days is up and going through the proper channels. But is this a better way to 'guarantee' we'll be allowed stay together, or are we just creating more hassle for ourselves in the long run by not going with a K-1?

Advice would be very much appreciated. If more info is required, I'll be happy to answer any questions.

The support requirements are the same for fiance(e) or spouse visa. Please study the guides and read other posts on the subjects you're asking about. They appear quite frequently.

As long as you are both free to marry and of legal age you can apply for the K1.

Financial details come into play at the Embassy stage of this process. If your fiance is working by that time he simply needs to state and prove the fact that he will now meet the minimum requirements. They are concerned with current income...not so much past...usually. If he still does not meet the minimum, then a co-sponsor is usually an option (note: he is still the sponsor and will need to supply all documents and supporting evidence as well..even if he does not meet the requirements).

Having said that, it's important to know what Consulate you will be dealing with as some do not take too kindly to co-sponsorship for a K1.

Do as pushbrk suggested and read all you can here on VJ. Pay special attention to the K1 Guide and Visa FAQ sections. Educating yourself to the process will help you make the best, and most well informed, decision for you.

I agree. Also from what I read some embassies will not allow a co-sponser as well..EVEN after you are married. Being married is NO guarantee you will get a visa.

there are some who are married and were denied.

If you have enough proof that it is a bona-fide relationship then you should be okay AS LONG as YOU have a sponsor. Remember this old saying..NO MONEY NO HONEY

All of us want to be with our sweethearts..BUT do it the legal way and bust your butt to get the income to make it happen:)

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!
