I arrived here in Johnston county, NC on Sept. 4, 2008 with my 2 kids, K1 and K2 respectively. Me and then fiance/now husband got married October 18, 2008.

We waited till after the wedding to apply for SSN just so we could have my SSN in my married name and not have to go back and forth changing my name. When we went to SS office in Smithfield, NC the lady told us that I am not eligible to get SSN since I got married already and therefore I am not a fiancee anymore and K1 only covers the fiancee... she was saying something about me being a K3 now since I am married and I was confused coz I thought K1 was one time visa which expired/used up the moment I entered US soil and my getting married do not change the fact that I entered the US on a K1 and therefore still be eligible to get SSN since my I-94 is still valid. The lady at the SS office said i will need to get EAD or go through the whole immigration process again as a wife of a US citizen in order to get the SSN.

I know I will need to go through AOS but I thought that is another story, we will surely do that before my I-94 expires but we sure want to have SSN beforehand. I never thought i would forfeit my eligibility to get SSN as a K1 just because I got married and I surely have never heard of anybody coming here as a K1 and then have to go through the whole immigration process to get a K3 after the wedding just to get SSN, it sounds crazy to me. Obviously the lady at SS office didn't know what she was saying but I also got so confused that I didn't know how to rebut the points she raised.

I hope somebody could help shed light on this. Any input will be greatly appreciated.

K-1 is eligible until day 76 of entry but the K-2's are not until EAD or GC

I think the lady at SSA didn't know what she was talking about. I went to SSA office that day after we got married. Its better you go back to the office again and go to another person.

Nag apply ako ng ssn after we got married and they asked me the same question,,,but ung guy sa ssn very nice and helpful,,he didnt give us a hard time..he called us in our house and told that we need to comeback at the ssn coz i need to sign the application kasi the 1st time we went there hinde na i process kasi im already married and im under k1 din at di pa na process or naiforward sa data base nila ung record ko sa immigration...thats the reason why he called us again..after 2 weeks i got my ssn with my hubby lastname na..!!!!

you mean, they just need to update the info that I am already married to immigration then I could apply for SSN without any hassle na? that would be nice... thank you very much..

I suggest you go back to ssa office and go to another person, I Know most of these people that are working there are so stupid, like they don't know anything about their job, just like what happened when I called on the phone to get my state ID and they asked what's my visa, I said I'm under K3 visa, the stupid lady told me I'm not eligible for it unless I have my gc already( I only have my ead, we didn't apply for aos yet coz my visa is good for 2 years) I said to her, why on your website it says there I can get a state Id as long as my I-94 is still valid and I told her K3 is a spousal visa, she was so rude to me, but you know what happened when I get there, I had no problem, I just brought all the required documents like SS card,valid passport and visa and I-94 and marriage cert and that's it, no questions asked about my K3 like that stupid lady I talked to on the phone, can you imagine if I listened to her and didn't go and try to apply for it, good thing that I know what are the requirements through their website and that I know I have to fight for I know what is right, not like those stupid employees here in the US who doesn't even know what they're doing, it's useless that the government is paying them, most of them are so incompetent, they're not like the employees in the Philippines who are so knowledgable and so reliable on their jobs.

The woman was wrong, but you might have made a mistake by waiting so long too apply.

September 4, 2008 and November 10, 2008 67 Days

So if your status doesn't verify on the inital input you might have to wait until you have an EAD card. If you don't go back tomorrow Tuesday is a holiday and that gives you 7 days for the secondary electronic verification to be done, which is possible if they send it right away and jump right on it when they receive a response, but I wouldn't hold my breath for that to happen.

i applied SSN after we get married so that i can use my married name. i dont have any problem. ate riza, applied SSN after they get married too, but SSA officer told her that she can't used her married name until she will get her green card. they don't have any uniformity of the information being relayed to us. knowing that they are just on the same department. most of them are not knowledgeble enough about their job.

try to go back there and talk to another officer or go to another SSA.

I had the same situation before and SSA in my city was really annoying. So what i did was i printed out the Guidelines for getting SSN and went to another SSA office and then they approved me but i got it after a month.

The same thing we did with my hubby...we went there in SSA here in CA last week after we got married....but the lady who works on that office tells me that i cant use my married last name not when i have my green card... :rolleyes: she said we will just com back when i have my green card to change my last name...i get really confuse about these things...since i arrived here everything is very confusing to me :(...

:no: Up to day 76 or after till marry, whichever comes first. Once you marry, you have to wait for either GC or EAD.

JG... Marriage does NOT change eligibility... marriage does NOT change the original entry status as a K-1...

Go back to the office today. Ask for the office manager if you again have a problem.
