Another question for you wonderful, helpful VJ'ers.

I think I decided to use a co-sponsor for AOS. However, my co-sponsor has an extension on his 2004 and 2005 tax returns and has not filed them. He has his W-2s for those periods, and permission for the exensions, but I have seen here that some people have received RFEs for not including copies of their 2005 taxes, even if they have not been filed. Does any one know of the reasoning behind this? Will it hold up my AOS/EAD if my co-sponsor has not filed his 2004 and 2005 taxes? Will they give me an RFE and make me submit the tax returns? I can't ask my co-sponsor to file his taxes when he is already going out of the way to sign the 864 and provide financial info. The last thing I want is an RFE, but I am afraid I will get an RFE if I *don't* use a co-sponsor.

Has anyone on here successfully filed their AOS without having filed their previous year's tax returns and not received an RFE?

I am also a habitual late filer. Does the cosponsor actually have an extension or has he just procrastinated becuase he knows he is due a refund?

Do you have any other options than this cosponsor? Most people do not understand that it is not a big deal to file up to 3 years late as long as you don't owe money to them.

11 May 05 sent petition to Bogota

18 May Packet 3 arrived

19 May Checklist taken to consulate

31 May Packet 4 delivered

29 June visa granted

1 July Visa delivered

Sometime in July Lucero came to US

13 Sept 05 Married

1 Nov 05 -USCIS recieved 485 and EAD

13 December RFE stupid things I should have included Returned very quickly

27 March received bio letter for New Orleans

7 Apr_06 Bio done in New Orleans

20 April 06 Touched on all applications

21 April Email received EAD approved

27 Apr Received EAD card

30 May 2006 Received appointment letter for JaX on 13 July 2006

13 July Interview successful approved

20 July Received green card

30 June 08 Sent I751 to remove conditions

25 July 08 Application returned erroneously incorrect fee

27 July mailed new application with separate checks

15 Sept 08 Application returned erroneously K2 not within 90 day timeframe

17 Sept Mailed 3rd application with mountains of proof of error copied Senator Mel Martinez

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

I talked to him today and he said he is going to try to file taxes next week. I'm not sure if that's a definite, though.

I was just wondering if not having last year's tax returns for a co-sponsor would result in an RFE if taxes hadn't even been filed due to an extension. I was wondering if anyone had gotten an extension on their tax return but then got an RFE because they didn't have their return in their packet. Or if someone had an extension on their tax return, didn't include the return in their packet (because it wasn't yet filed), yet had smooth sailing through AOS.

No other options except this co-sponsor, I'm afraid.

He may have gotten an extension for 2005 taxes.. but no way does he still have an extension in effect for his 2004 taxes... he needs to get them in.. and now..

One has to provide either the tax returns or a legitimate reason under the tax code why a tax return was not filed - one or the other. Some people do not submit either, that's why they get an RFE.
