Hi All,

My fiancee just acquired her tourist visa, she is from Turkey and I am a USC. I was wondering if this scenario is possible:

1. We get married over there (Turkey)

2. We come to the US, she comes on her tourist visa since her passport doesn't change.

3. I petition for the K3.

4. Then she goes back for the interview and what not after 2-3 months and that's it.

I know it sounds sort of counter intuitive but the whole point is that we dont want to be apart more than we have to because each time it gets harder and harder to be separated.

Any insight would be appreciated!

You can do 1, 2 and 3 but the visa process takes more than 2-3 months. If admitted, she can stay as long as her granted stay. Then she must leave, regardless of where the visa process stands at the time.

So technically instead of waiting in Turkey she can atleast come to the US and we could be together while the K3 is processing correct?

Not when the visa expires but when the I-94 expires. She can probably visit but a visa is not a guarantee she'll be granted entry. She can probably stay two or three months but that's a small part of a visa timeline. You should be expecting around nine months from filing to visa.

Depends, yes but not all. The visa itself will have a maximum length of stay, usually 90 days. The CBP officer can grant up to the maximum, not more.

Might be simpler you file K1 and she waits for it in Turkey

Then she comes and you get married

Papers in the US will be much simpler

waiting for K1 she might not be able to come for short stays

or she has to demonstrate at border that she will have to come back (a job for example)

Instead if you marry and she tries to go to the US with you on a tourist visa

you have no assurance she will be able to get in

you will have to go for K3 and it will take as long or more than a K1
