Over a month no NOA1?

I am using a lawyer to proceed with the K1 visa. He is based in Bangkok where my Fiance lives. No need to debate the pros and cons of that here, I just wanted this to be clear.

My lawyer sent our I29F packet a little over a month ago to the VSC. We have not received any NOA1 from the VSC, he claims they are delayed in processing that it may take another month to get the NOA1 and there is no need for concern. He has stated that they have a big backlog mailing out the NOA1's but that doesn't mean my case isn't being processed and I should already have my place in the queue. He is the one sent the check so I can't review if it has been cashed or not nor look for a case number on the back. He is a very well known lawyer in Thailand and I do not have any reason to believe something is fishy but nevertheless I am stressed and just want to know our case is moving along. After reading through the threads here I can't find anyone else who is facing this kind of lag. Can I somehow contact the VSC myself just to get assurance they have received my packet and things are moving along?

hi,

i think you dont need to worry, we waited like 2 months before we got our NOA1, and that's because they had delays in processing cases.we didnt use a lawyer so we could know when the cheque was cashed and right 5 days after the cheque was cashed we got our NOA1.Good luck.

wasabi,

For clarification, your I-129f petition was mailed from Bangkok? Are you able to confirm that it was received at VSC by use of a tracking number? As a rule of thumb, NEVER mail I-129f from abroad, since the petitioner sending it is the American citizen (or legal representative). Someone has already written about their petition being held up in customs for a time before being forwarded to VSC.

We received our NOA1 one week from delivery. I know a few other around the same time who had waited a little longer, so it does seem somewhat random how quickly they are received, but I do not believe there is a backlog in sending NOA1's.

All the best,

Pete

What I would do if I was you is to contact your lawyer and ask him for the number from the back of the cashed cheque, you are paying him for his services so he is there to help. Your case number will be on the back of the cashed cheque, also ask if he has tracked the package and for the date it arrived at VSC.

We got our NOA1 in a few days from VSC, sending it over a month ago and waiting another month seems way to long, and I dont know how he would know if there is a backlog at VSC

Good luck

I agree, your paying for his services, he should give you the number off the back of the cheque. Ours went to California and took about a week. Good luck!

Yes it was mailed for Bangkok. I think I will wait a few more weeks and if still nothing than I'll ask to dig up the check. He has been a family visa lawyer for a long time and is very competent so I have every reason to trust him, I just want to rule out that some random thing went wrong and they didn't get my papers.

It's good you did your homework before hiring someone and even better you are staying on top of things and educating yourself! ;)

btw... You say you filed a I-129f but your profile says CR-1/IR-1

I got my NOA1 a week after my check was cashed. two weeks total. unless something has changed I thought all applications were sent to Chicago for distribution.

Your going to be on this site again in a few weeks crying that you still havnt received your NOA1....with a approach like this that your doing..."I'll wait a few more weeks, he's been a family lawyer for years." OMG dude pull your head out. You need to be proactive in your approach to this imigration proccess. You need to always be one step ahead in the proccess, even more so with a attny. Do you think your attny really gives a #### about you or your fiance? Your just one of many clients he has and he can care less about how fast you get approved. It just astounds me in how much faith is put into lawyers, I did my CR1 visa by my self (no attny) and I was done in 4 1/2 months, why, I was proactive and always one step ahead.

Good luck in your wait and see approach.

That was fast!

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!
