Lizbeth, good luck with convincing your friend to pursue the immigration in the best legal way for her long-term. It sure is a lot of paperwork, huh? :)

My friend is also engaged to a man we met while being Peace corps volunteers in lesotho. she has seen all the work i've done for getting the fiance visa stuff rolling and she doesn't dig the price or the effort. her plan is to have her fiance come to the states on a visitors visa, marry him and then apply for a change of status. Does this work? Or will they get turned down when they try to get legally married? And when he changes his status, does that mean she will still have to pay the $930 fee for the status change/green card application? Anyone know how this works?

I don't think people marrying on visitors visa's has much to do with the pain in the neck of the K-1 or K-3 visa route, but it definitely has an effect on which countries can participate in VWP.

YuAndDan may not be a mod, but knows a heck of alot more than alot of us do, and is one of the biggest helpers on VJ. A bit of respect would be nice.

I don't think people marrying on visitors visa's has much to do with the pain in the neck of the K-1 or K-3 visa route, but it definitely has an effect on which countries can participate in VWP.

Coming over on the visitors visa with the intent to marry to get around the long wait and fiancial costs for the K1 or K3 is fraud and can be bannable up to a lifetime

Never ever advise someone to commit visa fraud. If it were me, I would tell her what was said, or better yet show her this thread. We have all learned a lot on here over the years.

The price is very high for what she is contemplating.

If your FRIEND loves this person, THEN she would do it the legal way instead of jeapordizing it. Being lazy is an excuse and will lead to a long time ban.

So as you can see IF she loves him she will do it the RIGHT way

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Captial Fraud... advice them not to, the prices of aftermath effects ....too high and risky just to save a couple of $$$

If it was that easy, all of us here would gladly do it too. Besides, to enter the US on visitor visa with the intention of getting married and settling down here is fraud. Remember, they will have to prove everything they say and the price for lying can be too big.

I agree... no need for attacks. It was a question not a direct intention to circumvent the laws. Dan is merely trying to keep the peace, as I think we all should as this is a community of support for each other above all else.

OP.. I think you get the point. ;) Circumventing the immigration laws and coming in with the intention of staying can mean serious consequences for your friends.
