Waivers are somewhat different for the removal of conditions. There is a section on the bottom of the form that you check off stating that you are applying jointly or if not jointly, you are requesting a waiver from the joint filing condition because of - a),b ),c), etc. You check off the appropriate reason, the most common one being that the individuals are now divorced so cannot file jointly. This is different than the type of waivers discussed over on immigrate2us. The waiver requested is from the condition of having to file the form jointly - the OP filed singly.

Where did you file your I-751? If it was Virginia (or Texas), then you have a good 11 to 12 months or longer wait. You can check the status list of other VJers who have filed here: http://www.visajourney.com/forums/index.ph...5&start=915

If you filed in California (or Nebraska), then you are looking at a 4 to 7 month wait. You can check the status of other VJers who have filed here: http://www.visajourney.com/forums/index.ph...5&start=255

Hi Guys i have some questions i will apply for my I-751 in January to remove condition with waiver , my lawyer asked me to bring evidance like tax return , and i have all that stuff , Mortgage for the house and Vehicle together , pics , emails etc.... , i want to know when my lawyer will file for me , is the USCIS will give me the extention so i can still be working ? and how long it take for processing to get the 10 years green card ? thanks i appreciate that.

Filing as a waiver is the same process as filing jointly, you must submitt the same quantity of evidence or somewhat more carefully choose the evidence that you sent. The only difference is that your ex has nothing else to do with it, and do not need to sign the form I-751. It is strongly advice to put a cover letter explaining what happened and if there were some extraordinary circumstances that influenced your decision to divorce. Is good that you had strong financial ties with each other like a mortgage, auto loans, etc. Remember to send copies, you keep the original and is good that you had an entirely set of copies of the package you sent.

The waiting period is the same as if you file jointly, depending on the Service Center, just add some weeks probably of extra review. There is not really any timeline about waivers. I read different cases and there are some that do not required interview, some required interview and other took longer.

Once you file, USCIS will send you the first NOA1 that extents your conditions for one more year. Later you will received the biometrics appointment. If your lawyer is the one who is filing and receving information from you, had an open communication with him so you received your documentation on time.

The lawyer will file once he have your decree.Same processing with the other I-751 filers, but the timeframe is unknown. It could be longer than 6 months or shorter depending on your case. mine was 6 months+ days..
