Help Please:( Unclear on Conditional Status

Hi everyone!

I hope someone can be of help with this topic (and I am sure this is an easy question)............my husband Permanent Resident Green Card expires within the next 2 months. We never confirmed if he has Conditional Permanent Resident Status.

After going through our documentation and researching, I believe he is under "Conditional Status" for 2 years and then prior to 90 days he needs to re-apply for Permanent Status to get a new card valid for 10 years. So if you got permanent resident status via a marriage it is considered "Conditional". Is this correct?!

That being said we need to fill out the I-751 document.

Also, If I am US Citizen do I need to do biometrics.

I am sorry for the ton of questions, but I am lost.

Conditional status is determined based on the length of the corresponding marriage on the date the greencard was approved. If it was less than 2 yrs. then conditional if greater then not. The conditional status is easy to determine... If the first greencard was good for 2 years then he is... If it was for 10 years he was not...

The USC is not required to have biometrics

You need to file an I-751 within 90 days of the expiration date on the green card. You should include all the evidence requested, but you can file some of it after you send the application. It is best to send it all with the application though. Don't wait on sending it in until the last day, get it done ASAP.

You do not do any biometrics, just your husband. They will send a notice that they received your application and then send a biometrics letter (hopefully) for the biometrics appointment. The receipt number on the biometrics letter can be used to track the case online.

Do some research on here as to what to send. There is an awesome cover letter example. Organize it well and according to how they like it. You need everything joint since your marriage. Bills, etc... can be one copy for each 6 months.

Interview Notice received 1/3/2006

Interview is scheduled for 3/6/2006

Changed Medical to 3/1/06

Interview went great and easy - Visa received 3/6/06

Customs - 2+ hours - 3/6/06

Applied for SSN - 3/8/06

Received SSN - 3/13/06 - 1.5 days to process and 1 day to mail - INCREDIBLE!!!

Wedding - 3/18/06

AOS, EAD filed 3/25/06

EAD Approved 6/23/06

Interview 9/25/06

Approved 9/28/06 !!!!!!!!

Now it starts again

I-751

I-751 Mailed 8/29/08

I-751 Received 9/2/08

NOA1 Date 9/2/08

Received NOA1 9/9/08

Biometrics taken at InfoPass Appt 10/3/08 - still no ASC Letter

Application has Supervisory Hold, Local Office is investigating why 10/3/08

12/8/08 - still no answer from Local Office and still no biometrics letter

12/16/08 - Card Production Ordered!!!!!

12/20/08 - Card Received !!!!!!

Now we wait until 6/20/2018 to renew the Green Card !!!!!

Waiting is tough, but oh so worth it!!!

Can I ask...if marriage doesn't work out in the first two years and couple divorces, does foreign spouse lose his ability to live in US? Just curious....
