Hi there,

I am a former K1 visa holder, the k1 was valid untilfebruary 23., my husband and i got married on february17....we haven't filed for an aos yet..we will do so, however, this weekend and mail it out by wedn next week

my question is : are we / am i gonna get in trouble for not having filed the aos until febr 23(expiration date of k1 visa?)

No, you shouldn't get in trouble. There are a number of VJers who filed their AOS after their 90 day time expired and they have had no difficulties. The important thing is to get married within the 90 day time period, then file to adjust status. The only potential problem is if you are applying for Advance Parole and have accumulated 'out of status' days. Get enough of them and you run the risk of being denied re-entry to the US if you leave, even with an AP, prior to receiving your Green Card. As long as you stay in the US until the processing is complete, you won't have any problems.

no, I am jus playing with you.

I filed my AOS after my wife's K-1 expried.

Technicly, your are out of status. once you sent in your AOS.. you are back into status.

my AOS case is slow.. expect from 4 months or longer.

It took about 2 months for me to hear from USCIS about our case and they just transfed it to Calif.

Of course you're not in trouble... you got married before the 90 days expired and that's the most important thing. Just file for AOS as soon as you can and you'll be fine.

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

Most people here are pretty anxious to file or they wouldn't be here. The common advice is to file quickly and there are some good reasons for that but if you had no need to work, travel, or draw SS and medicare I suspect that you could stay indefinitely. I have never heard of anybody being punished for not filing AOS in a timely manner. I think that your presence is legal based on the marriage.

Of course, I can also drive a car with my feet, but that doesn't make it a good idea!!!

You will be ok but get it in ASAP now.

I also wonder if it does delay your AOS case though. A friend and I both applied in the same month (jan 06) to the same office, I was in status and she was out of status - I have had bio's done a month ago and have my interview a month from now - she has literally NOT heard a thing!!! It is beginning to make me wonder if the out of status ones go on a don't rush, because they didn't, pile!! Hopefully for you all this is not the case but we all know the USCIS!
