What to do with yr emplyee when you are waiting for the 10 yr GC?

Maybe it's a silly question, but what you guys did or have done or are going to do with your employer when you are still waiting to get phisically the 10 yr GC, although you got the NOa that extends the 2 yr GC for another year?

You give to the employer a photocopyu of the NOA or you wait for the 10 yr GC?

Any suggestions accordingly to your experience?

K1 VISA: 07/25/06 GOT VISA!!!!!!

30th of September 2006 WEDDING

AOS:01/29/2007 received Permanent Resident Card (GC)

ROC:04/11/2009 received Permanent Resident Card (GC) expiring in 2019!!!!

N-400:

on 05/21/2010 Sent out docs to Arizona Lockbox Facility address via USPS

on 06/30/2010 Biometrics

on 09/24/2010 Interview Day - Passed the Test

on 10/19/2010 Oath - USA CITIZEN!!!!!

on 10/20/2010 I requested the US Passport

on 11/02/2010 the US Passport was received by Priority Mail

on 11/03/2010 @ the Social Security Office I changed my status from Resident to US Citizen

ON THE 3RD OF NOV.2010 MY JOURNEY ENDS, WHICH STARTED IN DEC. 2005!!!!!!!THANKS TO VJ & VJ PPL!!!!!!!!

Feb. 19, 2010 - N-400 Application sent to Phoenix Lockbox

April 3, 2010 - Biometrics

May 17,2010 - Citizenship Test - Minneapolis, MN

July 16, 2010- Retest (writing portion)

October 13, 2010 - Oath Ceremony

Journey Complete!

Yes you should give them a copy of your NOA2. An employer should request this once they see your GC has expired. If they dont' you should still bring it to them.

Your employer has no right to ask to see your greencard, all they are allowed to do is ask you to redo your I-9 form and for that all you need is a state drivers licence or state ID and a unrestricted SSN.

It is against the law for them to demand a Greencard.

Dec 20 2004 : NVC sent DS 3032 to beneficiary, copy of DS 3032 & I-864 fee bill to petitioner

Jan 3 2005 : Petitioner received copy of DS 3032 and I-864 fee bill. Post-marked Dec 23rd.

Jan 11 2005 : Beneficiary received DS 3032 in Indonesia

Jan 31 2005 : Sent DS 3032 to NVC

Feb 8, 2005 : NVC received DS 3032

Feb 21, 2005 : IV fee generated

Feb 25, 2005 : Sent I-864 fee bill

Feb 28, 2005 : I-864 fee bill delivered to St Louis

Mar 3, 2005 : IV fee bill received

Mar 7, 2005 : Sent IV fee bill

Mar 9, 2005 : IV fee bill delivered to St Louis

Mar 28, 2005 : I-864 fee credited against case.

April 6, 2005 : Received I-864 package

April 7, 2005 : Immigrant Visa fee credited against case.

We just gave my husband's employer a copy of the NOA1 that extended it for a year. When he gets his 10 yr green card, we will give them a copy of it.

I am pretty certain that the employer is legally required to have a copy of the green card on file, thus allowing them to ask for it at anytime.

Interview went great and easy - Visa received 3/6/06

Customs - 2+ hours - 3/6/06

Applied for SSN - 3/8/06

Received SSN - 3/13/06 - 1.5 days to process and 1 day to mail - INCREDIBLE!!!

Wedding - 3/18/06

AOS, EAD filed 3/25/06

EAD Approved 6/23/06

Interview 9/25/06

Approved 9/28/06 !!!!!!!!

Now it starts again

I-751 Mailed 8/29/08

I-751 Received 9/2/08

NOA1 Date 9/2/08

Received NOA1 9/9/08

Biometrics taken at InfoPass Appt 10/3/08 - still no ASC Letter

Application has Supervisory Hold, Local Office is investigating why 10/3/08

12/8/08 - still no answer from Local Office and still no biometrics letter

12/16/08 - Card Production Ordered!!!!!

12/20/08 - Card Received !!!!!!

Now we wait until 6/20/2018 to renew the Green Card !!!!!

Waiting is tough, but oh so worth it!!!

I work for a government contractor in HR and we have to have a copy of the GC on file to be in compliance with federal regulations - therefore needing to ask for it. AND FYI when filling out a new I-9 the proof of identification need be presented to the HR person signing the form, again the person must produce their permission to work in the US.

If a company is audited for compliance and it shows that there are non USC working for the company the company must be able to show that all workers are legally able to work or face very strict repurcussions.

An unrestricted SS card with driver license satisfies the requirement of the I-9. The employer cannot discriminate and ask for a specific document, it is against the LAW.

In this tedious process, we tend to forget that this is all worth it.

Document Abuse

Discriminatory documentary practices related to verifying the

employment eligibility of employees and the Form I-9 process

are called document abuse. Document abuse occurs when

employers treat individuals differently on the basis of national

origin or citizenship status in the Form I-9 process. Document

abuse can be broadly categorized into four types of conduct:

1) improperly requesting that employees produce more

documents than are required by the Form I-9 to establish the

employee’s identity and work authorization; 2) improperly

requesting that employees produce a particular document,

such as a “green card,” to establish identity or work eligibility;

3) improperly rejecting documents that reasonably appear to

be genuine and belong to the employee presenting them; 4)

improperly treating groups of applicants differently when

completing the Form I-9, such as requiring certain groups of

employees that look or sound “foreign” to produce particular

documents the employer does not require other employees to

produce. These practices may constitute unlawful document

abuse and should be avoided when verifying employment

eligibility. All work authorized individuals are protected

against this type of discrimination. The INA’s prohibition

against document abuse covers employers with 4 or more

employees.

All you need to show is an unrestricted SSN and a State DL or State ID, you do not need your extension letter or anything else. The Employer can use the E-Verify system to check if you are authorized in the same way they would for any other employee.

I'd say the other posters on here are 100% right. All your employer or mine (my GC is expired now) can do is ask us to fill out another I-9. If you have an unrestricted SSN and a valid State ID/DL then that is all thats needed. Employers have no right to ask for or demand to see a GC.

Having said that I think it's good, assuming you have a good employer to keep them up to date if needed and to send a copy of your new GC, NOA or I-551 stamp to HR. Then again if most HR are like mine then it'll just get lost from the file and no one will ever track it or ask any questions. :blink:
