Case transferred from Nebraska to California

Timeline

The is "hump" day of this week, and I am not optimistic about anything positive happening quickly after the the end of this week. I have not received any further notice or activity on my pending application since the NSC to CSC transfers June 1-3. Have any of the other "Nebraska/California" transfers received any better insight in to what has happened?

Approval of the new 129F may not be the fix. I presume that all these translated brochures to be given the beneficiaries will need to be approved as well. Maybe the agency doesn't want to issue NOA2's until they have the material ready to send the Consulates? Has anyone seen any OMB action on this aspect of the new law? And, why should we think that the new 129F form apply to those who have already filed and been issued a NOA1?? That gets back to the question over whether they are not already doing the background checks on the petitioners...

The new 129F form seems to me such a small part of the problem. I wish there was some better news to sleep upon.

After being transferred I haven't had any other touches. But I wasn't expecting anything. I don't think they are doing anything at all with pending applications until they have the additional necessary information from the USC - otherwise, I doubt there is much of anything to do.

The translated brochure part is necessary but wouldn't affect the processing of applications. They have to start somewhere and the most pressing issue is getting the information from the petitioner in order to comply with the law. I think the new form would apply to those who have already filed and received an NOA1 because they need to get the information in order to proceed. So they may as well create a new I129F that new filers can use as well as provide that form in place of a questionnaire or separate form to people with pending applications to fil in the missing info. This removes the need to create an "interim" form. Not sure if I'm making sense - it's late and I'm tired and I'm so fed up with all of this. But I can't imagine that this could take that much longer. They get the form approved, they send it out to us, we check the box, send it back and they get back to work. Fingers crossed that it's just that easy. Now get some sleep!

I spoke on the telephone with a woman who is a caseworker for my House Rep. in Michigan. I had emailed my Rep. about IMBRA, and the status of K-1 petitions filed after March 6th. I got a letter from this caseworker asking me to call her, and she would tell me what she knew. So... this is what she said.

-She reiterated the new IMBRA law, and what it's purpose was.

-She attended an immigration forum held by DHS and the State Dept. last week, in which congressional members and the like could ask questions. The topic of IMBRA and how to implement it came up, and said many congress members had concerns about it; apparently they have has a lot of constituents write or contact them in regards to this law.

-DHS said they are in the process of creating a form (didn't say what form, new I-129F or a completely different one) that would be sent to petitioners who filed after March 1st, 2006 (the date she said was the cut-off). They asked about a timetable of when to expect this form to be created and sent to petitioners, and they wouldn't say.

-She said I knew about as much about this whole thing as anyone does. Apparently I am one of three people in my congressional district that have files with my Rep.'s office in regards to this exact issue.

-She would keep me posted about anything new, and that I could call her anytime if I had other questions.

I gave her all of my information, case number, etc. but stressed that i was not concerned about my status, as my petition is still within the processing dates. I told her I just wanted to know what was going on!

So, nothing new really. Just thought I would share this with you all.

March 9, 2006- Sent NOA1

March 13, 2006- Received NOA1 from NSC

March 23, 2006- Touched

June 1, 2006- Petition sent from NSC to CSC

June 2, 2006- Touched

June 3, 2006- Touched

June 14, 2006- Notice from CSC that petition was received

i just read in the forum of k-3 that someone here did send petition in 24-05-0-2006 et got the NOA1 IN 7th OF MAY hope we can hear soon we too.....and that mean that the old form of I-129f ITS NOT AFFECTED OR CAN BE CONCELED.....

This situation does NOT mean that forms are not being accepted and opened. It means that they can only get to a certain point in processing without the additional information required of the USC petitioner.

If you filed after March 6 you are affected. But you should certainly receive an NOA as they will accept your package and open it. It normally takes about 14 days for the physical NOA to arrive in the mail. You will get it.

Then you will have to wait to be contacted by the service center with a new form or additional form or however they eventually decide to do it to provide the missing information.

That one I don't know for sure but it seems that anyone who filed on or after March 6 has been affected since March 6 was the day the law took effect.

We have not heard anything either!!!! we are still wondering if they are going to move us to the bottom of the pile or if our original NOA1 from Nebraska is going to stay. We are only hoping they get to it soon so we can get our RFE for the IMBRA questions and restart the processing!

Just got two e-mails from USCIS and came to check my case status. I've got a touch from CSC and the status has changed to show that they have recieved it.

yes, I had the same thought. I don't like their wording! Feb. 3 the last processing date and and June 14 the new "received" date? oy.
