Hey guys, two years ago, i came to the us with j-1 visa, which has two year ome residency rquirement. But I spent only several months and came to the US with F-1 visa. I got my SS card through my college and has been working off campus without authorization, but here is a situation, i got married four months ago, and i just started to gather my files and file for the petition, and just remembered that i had that visa. Has anyone heard this situation? I cant get any waiver. If i go to my home country and spend another 2 years and try tocomeback, im afraid they wont issue me a visa becuase, i think, theyll know i worked w/t authorization, so what do you think should I do?

Please guys open ur opinions. Im really stressing out

hey! I am here on a j-1 vsa with the 2 year home residency requirment. You NEED to get a waiver for that restriction, otherwise even if you get married you will have to go to your home country for 2 years. There are different criterias for which you can apply for the waiver. I asked my home country to issue me a no objection letter, and got a waiver thanks to that letter.

You will have to contact your embassy and ask them what the process is for getting a no objection letter. In my case, my home country asked me for an essay explaining my situation and why I would like to stay, and some other documents, after which a few months later they send me a no objection letter and they send USCIS a copy two. After that they have to study your case and give you a desiscion. This can be a slow process so you should get started ASAP... however it is not THAT hard to get the no objection letter.

When you cam here under the j-1 visa what kind of program where you doing? Did you pay for the program or did your goverment or the USA goverment pay fo it? If it wa pais by either governments you are not eligible to geta waiver...

Yeah, it was paid by government, i came through high school program which was paid by government, i went home and stayed for almost five months and came with F-1. I called my embassy last week, they said they won't do it because if one does it the other ones will ask for it. What should I do? I can't go home, because I might get denied after, because im using my ssc which doesnt have an authorization. I love my wife, and I can't get separate, and I need to file those docs, what should I do? you mean, even though they will give an no objection waiver, USCIS will deny it because my program was paid by the us govt?

Please help, I hope there will be a solution,

Hey!! You are in a difficult situation.. I know you are not eligible to get the no objection letter if one of the governments paid for the program... read this http://travel.state.gov/visa/temp/info/info_1288.html it gives you all the different criterias to apply for a waiver.
