Hi, everyone. This has been a long, insanely trying waiting period. Finally, I received our most important mail today: APPROVED for both petitions. I can't believe it. Remember the letter I wrote a few weeks ago, tryin gto act proactively while shedding light on how the long separations we endure b/c the processing times are so long and draining? Well, after I received email responses to my letters, which I mailed to each senator on this Judiciary Committee, the approval notice came :dance: . Please see below and if you like it, feel free to copy and edit in any way you want. All the best--Amor1

Guidelines:

Print out a copy of this letter after you add your information. **Remember to add you House of Rep Member/Senator for your state. Again, this is protocol.

You can address your envelope to the Senate Judiciary Subcommittee on Immigration, Refugees, & Border Security or each individual member who sits on this committee as well as your State's Senator. Personally, I will be forwarding a total of 11 letters (all members, the Subcommittee, and my State's Senator). It's up to you.

I believe including hard copies of the spreadsheets is necessary, but many will send these, so you don't have to do this. My letters will go off tomorrow, and as soon as I get responses, I'll add a new message here at visajourneys.com.

To the Honorable Members of this Subcommittee:

As a law-abiding US citizen, I, along with my fellow members of visajourney.com, request your assistance with our USCIS petitions. At present, the time frame for reviewing cases is nine months or longer. Despite published announcements to the contrary, many of us have been separated from our spouses and children (on whose behalf we filed I-130 and I-129F petitions) for a painful amount of time, time which cannot be recovered. After following the guidelines posted on the USCIS website and paying all applicable fees, we are waiting in suspense for an approval (the Notice of Action 2 – NOA2), and this is the source of our dilemma—an inordinate amount of waiting time and no clear explanations for delays. Hence, we ask you, Honorable Members of the US Senate, to investigate these seemingly negligent periods of inaction.

The first step for our family members is to submit the petitions to establish the existence of a relationship. Then, once approved, our petitions and all documents submitted are forwarded to the National Visa Center for further processing. As you are aware, the next phase is the embassy approval with required medical examination and interviews. Unfortunately, many of us have not moved past the first step because there have been no updates sent to us. In particular, many of us are still waiting for NOA2 from the Vermont Service Center (VSC). Please see attached spreadsheets. While the California Service Center seems to be processing petitions at an increasingly rapid rate, VSC is months behind. Why is there such a major difference between these two processing centers? Are there more adjudicators at CSC? Moreover, some petitions that are received months after others are processed faster. When questioned about this inequity, telephone operators at the USCIS give a standard response: “It depends on the case; each case is adjudicated differently.” Then when we ask about our individual petitions on behalf of our qualifying relatives, we receive the generic, “We’re within our processing time.”

For many of us, the entire process thus far has proven to be quite discouraging. We cannot get accurate, specific responses to our inquiries, nor do we receive the “first in, first out” treatment we were promised. Hence, we need and request your assistance. Perhaps an inquiry from your committee will garner more substantive, more accurate responses. Perhaps there is a way to change the process, so national security is not comprised, and families are not unnecessarily separated from their loved ones indefinitely. Attached, please find a copy of NOA 1 for our petitions (I-130 and I-129F). Below, see our receipt numbers given by USCIS. It is with great respect for your charge on this committee that I, along with many others, request your inquiry into this matter. Hopefully, all of us will receive the NOA2 and continue positively on the path of reunification with our family members. Equally, we hope that others will benefit from our proactive measures and their processing time will be much shorter and more humane.

Well, I should have sent those letters out 2 weeks ago, but didnt. After getting off the phone with USACIS just now, I will mail those.

They told me they are only processing those from March 4. When I questioned why it says 6 months then, they said they cant go by that, because that is just an estimate. I told them that is not what their web site says, and I would read it to him if he isnt aware. He told me he is aware, but I told him apparently he is not based on what he is telling me. So I read it to him, and he put me on hold again, and told me again they are only processing ones from April. I asked why then is it that those who submitted theirs the first week of April, some have already been forwarded to an officer? He said you cant compare, each case is different. I said they are applying for the very same visa, a K2, submitted the same time as mine. I asked how is that case any differnet? He said because there could be things lacking. I asked him what is lacking then on mine. He said he cant, because no one has looked at it. So I said "so then you dont know that is why mine hasnt been acted on?" And he said yes. Around around we went... Finally I asked to speak with an officer, who told me the same, about March 4. Her and I went around and around about the dates too,and finally she said they would look into it and send me a letter within 30-45 days.

Sigh... :wacko:

I will send those letters to the oversight committee. Thanks again for preparing that letter.

I don't think the letter helped whatever, 'cause according to your timeline and Visa journey calculations it said for your I-129f that "Based on timeline data, your I129f may be adjudicated between November 1, 2008 and November 15, 2008" and for your I-130 "Based on timeline data, your I130 may be adjudicated between November 24, 2008 and December 5, 2008" and 'cause I believe these time estimations are pretty accurate 'cause it's according to USCIS service centers processing dates! SO YOU WERE GETTING APPROVED ANYWAYS! ... Congratulations anyways!

First off, I'd like to say "Congratulations!" It's great news!

Second, I have to agree with pushbrk here. I'm not necessarily convinced that the letter is what caused your NOA2s to arrive. In fact, based on your timeline data, you look to be right on target for when you should have been adjudicated.

When I filed my petition last year, VSC was much faster than CSC. Everyone going thru CSC was griping over their processing times. I honestly can't tell you which center processes "faster" on average, but it seems that both centers are susceptible to delays.

I suspect that the reason why there is no information during the "processing time" is to specifically discourage people from asking. Given that it requires months, people may be calling every week to check their status if they felt they could get even a nugget of information like, "Your file was moved from filing cabinet A to filing cabinet B". (Even on VJ, some people are obsessed with "touches". I have no idea why.) Now USCIS would have to hire a bunch of extra people to be able to look this information up and dole it out to everyone ... and it's really not even helpful information.

Thanks 4 your good wishes. No, there were no emails. After the senators' staff members sent replies, I checked the USCIS website & there it was on line. My husband and i feel more hopeful now, and I believe the letter helped a lot. I was hoping it would help all of us. All the best--Amor1
