Obtaining Florida State ID---help

Hello everyone B) I arrived in Florida on Aug 16,2008 and got married on Sep 19,2008.

Today, Nov 5, my husband and I went to the office (Department of motor vehicles- the people who issue the state ID) to obtain a state ID but the lady in charge told us that I cant get an ID because my visa is expired dated October 21,2008 and my I-94 is about to expire which is on Nov.14,2008. She also told us that they only accept valid documents with 30 days left prior to expiration which obviously made my only document (my passport with visa) invalid.

My husband and I explained to her that the date stamped on I-94 is for the deadline to be married in order for me to stay. We showed her my marriage license but she didnt accept it. We told her that filing for AOS has nothing to do with the I-94. Then she replied that we need something from the immigration to prove that I am here legally and allowed to stay here.

Since I am not filing for AOS till possibly January, how can I obtain a photo ID card from the state of Florida with the documentation I have (which the lady said is expired)? Are they making a mistake in the interpretation of K1 visa or the other way around? Is there anyone out there knows who I can contact next to try to get a state ID prior to filing of AOS? What document is the lady referring to which I need from the immigration? Does anybody know?

As in most states (probably all states), you will need some kind of immigration document that show that your status is legal for at least 30 days until the doc expires (such as an EAD). They will only issue an ID or D/L that is valid until the document you used expires.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

We were lucky. My husband already had a DL from being here as a tourist, that was expired.

We extended that one after getting SSN (14 days after entry K-1) beginning of September.

They took the NOA1 of the K-1 as approval letter and are allowed to issue a temporary one year DL with a NOA1 showing legal residence.

I guess it should have been the NOA1 for AOS, but now we have time until GC arrives and then extend it.

But it is a lot more complicated since 9/11 and they told us it will be more restrictive starting in October.

With EAD it should work.

We had the same issue with my wife

we went to apply today, with only about a month before the K1 visa expires

the lady gave us a lecture about how this ID will probably not even get to us

as the ID will be expiring within 4days of issuance

i told the lady to go ahead and to place the order even if the DMV doesn't approve it.

it is suggested to get the ID card the minute He/She arrives from the foreign country

well, i didn't know this neither did my wife.

not every state has the same regulations

and not every foreign goes thru the same hassles.

All is well, getting ready to apply for her green card anyways..
