map1map, if it makes you feel better: i still cant track any of my cases online. You`re not alone in your frustration.

Good morning everyone!

Holidays are over and kids back to school. Back to reality lol

I just wanted to let you guys know a piece of information I was told. The reason the other 2 people above have received interviews is they arrived via the "VWP" such as myself. From what I am told 80% of you who came via K1 and other visa's will just be transferred to CSC and be approved without an interview. You will also receive the EAD and AP alot quicker then us entering on VWP.

So I would not stress too much, we as November Filers are moving along pretty smoothly!

Again this is what I was told (From a USCIS worker nonetheless) so take it as you will.

Hope that helps a bit!

Visa waiver means that for trips shorter than 90 days, citizens of countries for which the US applies the VWP don't need a tourist or business visa to travel to the US. Citizens of Canada, Bermuda and Mexic have a different regime, see information here:

11/17/08 : Application sent (I-130, I-131, I-485, I-765)

11/18/08 : Official receipt of documents stated on I-797C (Signature for receipt at USCIS was on 11/17/2008 at 10PM)

11/28/08 : NOA Received ( I-797C) for all 4 forms (forms issued on 11/26/2008)

12/18/2008: LUD on I-130, I-131, I-765

01/29/2009: Bio done

01/29, 30/2009: LUD on I485 and I765

2/10/2009: issued AP, valid 1 year for multiple entries.

2/23/2009: Got EAD card

3/8/2009: LUD on all applications. Shows approval of I131 and I765, still pending on I130, I485.

04/28/2009 at 9:30 AM: Interview. Told to wait 90 days for a resolution by mail.

05/01/2009: Card production ordered.

05/06/2009: Received approval NOAs for I130 and I485 (welcome notice, 10 years card). I130 still shows case received and pending.

06/18/2009: got the 10 years validity card. Process length: 213 days since sending the applications.

No RFE at all along the process.

There's only 34 countries participate in the Visa Waiver Program (VWP) and Canada is not included in the list. Thanks for the info.....

wow thanks for the info. i hope that doesn't mean something bad for me and the fellow VWP'ers.. im really nervous about that, i have to say. i didn't do anything illegal since i didn't plan to marry when i came.. but still.. im really young and i don't have a lot of evidence.. i lived with my mom in germany. the only thing i have is my bank account and my enrollment in a german university that startet in october.. my flight back was end of september.. :(

08/26/08 - arrival on VWP to meet my boyfriends family for a month

09/29/08 - heartbroken, didn't take flight back

10/26/08 - surprising proposal

10/31/08 - halloween wedding :)

11/07/08 - I-130, I-485, I-765, I-131 sent via USPS express

11/10/08 - package received

11/19/08 - checks cashed

11/25/08 - NOAs received

12/08/08 - RFE received

12/11/08 - Biometrics

12/12/08 - RFE send back

01/09/09 - EAD/AP approved

03/10/09 - interview (pending approval)

03/20/09 - welcome letter

03/31/09 - green card received

Does the interviewer will give us a hard time? I still had ny return ticket to Canada that I didn't use, but it still good 'til July 2009. I do still have a bank acount, credit cards, and student loan in Canada. I also had an employment history from service Canada stating there that I was still employed ( left Canada on July 19, 2008) until July 25, 2008.

Canada is indeed a part of the "VWP".

Basically if you entered the USA with just a passport or drivers license USCIS considers you to have entered via the "VWP".

For instance I drove down to FL from Niagra falls to drop off my then gf and spend a few weeks there on vacation. I only needed to show my CDN DL at my POE.

i just realized that after the long and arduous process for K1, it's hard to deal with the USCIS again. though i did not receive RFE for the K1, it took 164 days before it was approved. i can't help but start to worry again. no offense to those who did not go through K1 or K3 but i somehow don't understand why they got an earlier interview date than us. is it because we will not be interviewed anymore? my case has not been transferred to CSC yet so it is still possible that it will be transferred to a local office. please don't get me wrong here. i do know that regardless of how we get here, I believe that we all have good and clean intentions. i am just a bit confused about the process that's all.

This was basically why I posted above. It looks like those on VWP are 'skipping' the line if you will - when in reality they are not.

Most likely you will receive your GC without an interview. They have already interviewed you during your k1 process. You will most likely (again this is not set in stone. Every case is different.) recieve your EAD and AP alot sooner then those on VWP as well.

Hang in there, it will come.

Basically if you entered the USA with just a passport or drivers license USCIS considers you to have entered via the "VWP".

thanks brian. i hope that we can all get through this phase because it's really hard not being able to work etc just because we don't have the necessary documentations.

The VWP doesn't apply when you enter the US as a visitor from Canada. Take my husband, he entered as a visitor. There was no VWP involved. That is a process just like other visas. Entering as a tourist is entering as a tourist.

When I first started this journey I made the same mistake telling my lawyer he entered under VWP and he then explained to me the process which is different than a tourist entering for a visit.

11/10/2008 - Got word from Lawyer that paperwork is final and to come in on the 12th to sign and send!

We got our appointment letter!!!
