Just a silly question

My husband and I are at the point of waiting two years to lift the conditions. I am just wondering, we are planning on having children, but I am not sure how the citizenship deal will work for them. If I have a kid, will they be american or have both canadian and american citizenships? My husband has a daughter from a previous marriage, were also wondering if it is possible for her to apply to have dual citizenship also... Just curious incase something ever happened and I moved back to Canada.

I think she means that the Conditional Green Card was obtained 2 years ago, and now it's time to Remove Conditions.

The US and Canada both allow parents to transmit citizenship to their offspring. In fact all chldren born in the US are automagically USCs. If you report their birth correctly to Canada, your child born in the US would probably also be a Canadian citizen. It's actually not clear who is who in your question, so I can't say anything about a daughter..

Anyone born in the US is automatically a US Citizen at birth (unless their parents were in the US on diplomatic passports). That's in the 14th amendment to the Constitution, as well as INA 301(a)

Any child born abroad of one US Citizen parent is a US Citizen at birth, as long as the US Citizen parent spent at least five years residing in the US, at least two years of which were after the US Citizen's 14th birthday. That's in INA 301(g). If this applies, you may want to file a consular report of birth abroad to document the child's US Citizenship.

Children who automatically acquire US Citizenship at birth may also acquire some other citizenship at birth. US law stays silent on the point of citizenship in other countries. Any other citizenships are a matter of the other country's citizenship laws.

I'm not sure of Canadian citizenship laws, but I believe they have roughly similar provisions that will likely make your children dual citizens.
