Hey guys! I am filling out the form I-765 Application for Employment Authorization as part and parcel for my AOS Application. I entered US last Sept 2, 2008 with K-1 status but I did not file for an EAD immediately when I arrived here, that supposedly would classify me for category (a)(6). It made me confused on what code answer should I fill out in question 16 of I-765 form, given with the two choices of codes as the answer ©(9) or (a)(6). I am considering

(a)(6) as the category that applies on me but I am not quite sure. So which is which? Please :help: .

From the instructions for form I-765

I am filling Eunices out today.

"K-1 Nonimigrant Fiance(e) of U.S. Citizen or K-2 Depent-- (a) (6) File your EAD application

if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD

application other than for a replacement must be based on your pending application for

adjustment under ©(9)."

This is just clear as mud.

I would say under 90 days and filing with I-485 as I am doing today it is (a)(6),

past 90 days and filing alone it is is © (9)

when I filed EAD along with my AOS i wrote c ( 9) since i came here as K1.

01/03/2010- Receive NOA

01/10/2011- Email from USCIS for the Required Evidence( Finger printing)

01/26/2011-Biometric Schedule

02/07/2011-USCIS online status update-

02/12/2011- Received Interview Letter Scheduled March 14

02/12/2011- Received Descheduled letter

02/17/2011- USCIS online Status update

02/22/2011-New IL arrived schedule for March 29

02/22/2011-Descheduled Letter Again ( 2nd Time)

02/23/2011- I called USCIS and I was told new schedule in the computer for March 22

02/23/2011-USCIS ONline update....

03/01/2011-Interview Letter for March 22 @ 7:15 AM

03/22/2011- Interview and Oath; US Citizen

AS I said this is clear as mud.

Is it (a)(6) when filed with the I-485 and © (9) when filed seperately

or © (9) for all aplications??

This is giving me a head ache.

By the way , you can get a duplicate approval notice Form I-797 by submitting a Form I-824 and paying a $340 fee.

no, it is alwaysd c9 when filed with or after an I-485

Its ( c) (9). This is one of my mistakes in filing I-765 concurrently with I-485. And because of this mistake I ended up with having TWO EAD cards in my hand. Anyways its a long story. But I dont know if its a good thing but I guess it is because i have two blessings.lol . Anyways again, its ( c) (9)

AOS & EAD TIMELINE:

July 21, 2008---(ORIGINAL) NOA1 for AOS & EAD

July 29, 2008---"WALK-IN" BIOMETRICS DONE (AOS & EAD-1)

Oct 14, 2008---EAD1 CARD ARRIVES! Approval date is Oct. 2, 2008

Dec 10, 2008---INTERVIEW DAY! APPROVED!!!

Dec 17, 2008---WELCOME NOTICE RECEIVED

Jan 9, 2009---CARD RECEIVED FINALLY! Approval date 12-10-08..expires on 12-10-10

REMOVAL OF CONDITIONS

Sept 10,2010---REMOVAL OF CONDITIONS

CITIZENSHIP

Sept 10,2011---Application for citizenship
