hello everyone!!

we have problem about the SSN coz my fiance called the office here and said that i can't get my SSN

until i get my permanent residence card :protest: :protest: :protest:

which is i know not true because of all the proof of VJ members who already have their SSN.....

i really appreciate ur help about any website where i can get proof that i am eligible to get it.... :help: :help: :help:

we just applied our marriage license today and planning to settle all the papers after we got married.....

The worst case if you miss the K1 window is that you still only need an EAD card to get a SS#, not a PR card. Your fiance (and I'm sure you know this) was given inaccurate information. If your passport is stamped with a temporary work permit (which will be good for 90 days) you can just walk in, bring your passport with visa, I94, and stamp, and just fill out and turn in the application for processing. I think the recommendation is to wait a couple of weeks after you arrive to allow your info to update in the system.

It's not always good to call. The worst of the worst government drones are taken from dealing with actual customers face to face and given phone responsibility where they can more successfully hide their lack of competence and pursue a career in knowing nothing, having responsibility for nothing, adding value to nothing, and doing nothing of value to anyone, anywhere, at any time, all day long, every day. I am confused.

JFK stamps a temporary work permit in the passport. It is only good for 90 days and usually doesn't do a whole lot of good for anyone.

Everyone else must wait for the EAD or GC.

K1's get a 90-day work permit stamp at most points of entry and can apply for a SS# a couple weeks later. Your fiance should have gotten one when she got her I94. I have heard (and read) that sometimes you have to "remind" the immigration officer to stamp the passport. IF your fiance did not then the SS card application has to wait until the EAD card is approved and arrives in the mail. The PR (green card) is certainly not required for SS card application.

Temp EAD stamps are actually quite rare and certainly not given at every POE. There is a running thread here on VJ that lists POE's that have recently issued the stamp. As stated previously, hardly worth the extra effort for most.

In regards to your SS#... whomever you were talking to was wrong. This happens more often than you might think. You need to talk to a supervisor and, if need be, carry along a copy of the law stating your fiance is entitled to a SS#.

We have not even applied for AOS and have already received his card.

This works for K1 visa holders. Walk in to the nearest office and wait your turn to be seen. Take a filled out application with you. Also take this document.

It's long and you don't have to print the whole thing. Print the first page and highlight these words.

1. General - Evidence of Employment Authorization

Employment authorization for nonimmigrants can be determined by:

the alien's class of admission code as shown on the I-94 (the non-immigrant classifications shown on the I-94 with employment authorization inherent in status are listed in RM 00203.500C.1.); or

That is saying they can determine if you have work authorization by visa type and to look at Section RM 00203.500C.1 of this document to find the list of Visas which have employment authorization.

So now find that section (just click on the link and it will take you there.) Print that section (section C, #1)through the end of the chart. Highlight the words:

C. Policy - Employment Authorization by Class of Admission

The following policy applies to employment authorization by class of admission:

1. Aliens Work Authorized Without Specific DHS Authorization

and in the chart
highlight the K1 line.

That's what helped us show the worker who didn't have experience with the K1 process that it was indeed okay to issue a SSN.

Now you may be asking, "so can I work without EAD?" No, but you can get a social security card. It sounds confusing, but doing what I just described to you worked for us just 4 weeks ago.

just a tip - bring ANYTHING you think they might ask for... obviously the correct form(s), correctly filled out, and the print-out from the link above (which I also brought when applying for my SSN, but didn't need ;) ) - but bring your birth certificate, passport with the stamped visa, marriage certificate; anything you can think of... the wait is usually VERY long, and you don't want to get to the desk finally, only to be told you're missing something and you should come back another time! :no:

Yes, you definitely need to have your passport and the K1 visa. Also they looked at the I-94 form. She was insistant that she had to take the name for the SS card exactly as it was written on the I-94. That was kinda weird because he couldn't have his middle name on the card since it wasn't on the I-94. Not sure I'm buying that.

Yes, you definitely need to have your passport and the K1 visa. Also they looked at the I-94 form. She was insistant that she had to take the name for the SS card exactly as it was written on the I-94. That was kinda weird because he couldn't have his middle name on the card since it wasn't on the I-94. Not sure I'm buying that.

I recommend reading the 2 links shown below. They may only confuse you but there are links there to all the regs and info you could ever use. The long and short of it is that a K1, with proper documentation in their passport, can apply for and receive a SS card. The card will be restricted to work authorized by DHS but this is automatic per the K1 visa. All this information is stored in a computer program called S.A.V.E. and the SS guys will know exactly what this is. It is not a trouble free process and you will discover this as you proceed down the immigration path. We all have gone through this. Just grin an bear it <_<
