If you are bringing a K1 fiance or K3 spouse immigrant to the U.S. I strongly recommend that you do not dismiss the idea of a prenup, if you own a home, have other assets, and most definitely if you have heirs.

I learned the hard way. I brought my wife to the US. Before we married she assured me that she would not want anything financially if things did not work out. She even said that she would return to her country. However when the marriage did not work she expected part of the value of my house, part of my retirement, part of my investments etc. In my state assets aquired before the marriage remain with that spouse, so I was protected. However, coming from a country that is not litigeous, and not trusting her own "American" lawyer, and a fair amount of greed or whatever, $8000 was spent by me in legal fees before she understood that she was not going to get any of these assets. She got a car that we purchased and she gets maintenances for awhile because her income is lower than mine. And this was maintenance that I was prepared to give her if we kept lawyers out of it. All of this on a marriage that did not even last 2 years.

With a prenup, all of this could have been worked out ahead of time and my non-retirement investments could have been protected, with a few hundred dollars spent on a prenup.

Romance, love... all fine. But marriage is a contract, subject to division of assets. Why not protect both parties.

With my fiance, we will have a pre nup that will also protect her. If things go south, she will know that she will have maintenance, moving expense etc, and predetermined divison of assets that will be fair based upon how long we are together. After several years the prenup will go away.

I am crazy about my fiance, but I am realistic.

We talked about making one, but really, we both have absolutely nothing. We'll only gonna check what PR's law says about inheritance, if he's entitled to my inheritance or not, so that we don't even involved our parents into our relationship.

Of course we don't think we'll ever get divorced, but we're also not blind to the fact that divorces happen all the time.

Is there a site where they explain about the different state laws? We discussed a prenup once, but we didn't decide to do it or not.

I think they are a good idea to have if you have large asessts. Protect yourself in the event the marriage doesnt work out. It's impossible to know someone 100% through and through. If the fiance gets offended then oh well if the tables were turned would they do the same thing? Some people marry for the money and are good at hiding their intentions and then you lose everything you've worked so hard for.

Might be wise...but each situation is so different. For every messy divorce like yours, there is happy marriage to contrast it. I don't think every marriage should start that way. In fact, in many cases I am sure the spouse would be quite offended by it and if anything, that fact alone could cause friction...............and just from the start of a possible marriage.

Could work both ways.............could be used to protect you, as you said...................or could become the focal point in a marriage......to further cause mistrust and resentment right from the get-go.

I can see it going either way.

I don't think prenups are a 100% thing for every marriage.

I don't have one in mine.....and with my wife, as others here have stated in regards to their own spouse............I trust her more than anyone. (we've been married now just over 2 years).

They are not for everyone...........nor every marriage.

I guess the important thing is...................be prudent in who you decide to marry. ;)

April 14, 2007 Visa delivered! Wife is finally going to be on her way back home!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

April 20, 2007 Wife enters through JFK. The days of grabbing my dinners at the WalMart deli....are now officially over!!!

I do believe prenups can be a good thing. But they aren't always a fail-safe. They can be contested just like wills.

If you're lucky you'll find somebody who WANTS to sign one. I know a man whose practically penniless fiance would not marry him without a prenup protecting him. He had been burnt before and she wanted to prove to him - in writing - that she expected nothing more of their marriage than his love.

Here is a site with divorce laws by state. To be certain of the law, I would look at the law for the particular state. Seems most states have a website with all of the laws of the state.
