Hi VJ member,

I have filed the AOS/AP/EAD, they received on 9/2/08, send me the NOA on 9/4/08, I also did the Biometric on 10/3/08, I have an emergency and need to go back home, someone told me that I can try to get a temporary visa thing/AP to leave and safely return, is that true???

Also, if I really can get the AP before my travel date, how do I use it when I am at the custom? Do I LINE UP AT THE INTERNATIONAL side? I am holding a Hong Kong passport.

Also, my uncle immigrant to the US a few years ago, and he has a green card, does he also line up the international side at the custom also??

Is it only US passport holder can line up at the US citizen side?

Since your Biometrics is done then there is a possibility that you could get the Expidited AP, but you would have to prove the emergency (Which is no less than an immediate relative dying) they are strict about it! Make an INFOPASS Apointment and ask them specifically what you would need to get the AP Expidited.

You don't have a timeline up but what you are adjusting status from also plays into this as well!

You do have to go to the International line and go through customs. Yes

Make an INFOPASS Apointment and ask them specifically what you would need to get the AP Expidited.

You don't have a timeline up but what you are adjusting status from also plays into this as well!

You do have to go to the International line and go through customs. Yes

You do have to show extreme urgency and it does have to be an immediate relative, not a distant relative (even a first cousin is considered distant).

My brother did not die, but was in ICU for an extended period of time. I got a letter from his doctor with information on his condition and presented that. At the same time, my cousin died and while I was at the infopass discussing my situation, they told me that a cousin was not a close enough relative to warrant emergency AP. :(

If you think you qualify, make an Infopass, take all your NOAs, 2 photos, and go plead your case.

Well, it was only a tiny bit extreme.

I called the mis-information line and because my I-485 was not visible online, I got put through to the actual IO who explained to me what my options were and how to do it. He did tell me that I could try and go without Infopass appointment, but it was up to the guards at the door to let me in or not. Since I had to wait for a letter from the doctor, I immediately made the Infopass appointment. By the time the doctor's letter arrived, I decided to just wait the extra couple of days 'til the infopass. I guess that was partly because I lived 3 hours from the Seattle office at the time and it seemed a long drive to make on a possibility that I could get into the building.

I basically had to tell them that my brother *might* not make it. He was in ICU, and in the end he stayed in there for over 5 months. So he was extremely ill.

They were very nice and quite sympathetic. I had to fill out the AP form again - basically a new one as the original one goes to MSC and not the Local Office. I didn't have photos with me, so I had to go out to a Rite Aid nearby and get them done. But after I got back with photos in hand, it was just a matter of waiting until they got the AP done up for me.
