can anybody suggest me, should we need to file the petitions for unmarried sons over 21 on LPR OR USC, while my father has LPR and he will get the USC

can anybody suggest me, should we need to file the petitions for unmarried sons over 21 on LPR OR USC, while my father has LPR and he will get the USC after 3 years?

Yes a LPR can file a (I-130) for unmarried son or daughter over 21 years of age. One your dad becomes a USC then he can upgrade the petition and that will be faster.

So let your dad file the petition right away and that will save a lot of time at least 3 years.

07-29-2008 I-130 to Chicago lock box

07-30-2008 CSC received I-130

08-01-2008 NOA1

08-05-2008 Touched

11-25-2008 NOA2.

As a USC they are processing petitions from May 2002

As a LPR they are processing petitions from Jan 2000

So, at a minimum it is a 7 year wait or longer

why this case is taking to much time???

As a USC they are processing petitions from May 2002

Because unmarried sons of LPR over 21 are not considered a priority. To me, this makes sense as minors, orphans, and even spouses should be higher priority.

Because unmarried sons of LPR over 21 are not considered a priority. To me, this makes sense as minors, orphans, and even spouses should be higher priority.

To clarify, preference visas come after immediate relative visas and have to wait for a visa number to become available. Visa numbers are limited in your situation.
