Apply for travel visa while filing a K1?

Hi,

It is my understanding my fiance (who I filed a K1 visa application for) is not allowed to try getting any other type of visa, including a tourist, while our application is processing. Is this true?

My buddy's fiancee is from Germany & she has visited the US... my fiancee is from the Philippines & she was denied a tourist visa while we waited for the K1. The moral of the story is it depends.

I read the question in the link and i am still a little confused. It it saying that the beneficiary will have a harder time coming to visit for a short time if they already have the noa2 or already been approved for k1 visa? I hope someone could answer this question for me.

If she is already approved for a K1 why do you need a tourist visa?

Why does it matter? Why do people so often need to know what is none of their business?

Maybe the person would like to travel to the US and stay there for, maybe, only a few days. K-1 is valid for six months and not everyone can be ready to leave and not come back to wherever they come from the moment some Embassy stamps their passport. At the same time, not everyone in the world is dying to immigrate to the US, either. Maybe K-1 was their only option, for instance, and they would have loved to be able to avoid it, actually.

To the OP: I am not sure if it's possible to hold K-1 and B2 at the same time. While K-1 is pending, it of course IS possible to travel to the US on a B2. Whether or not you can get one is.. another story. I'd rather not get into that. =/

This is another case where correct terminology and meaning is critical. An "approved" petition is not a visa. If the foreign fiance has a K1 visa in their passport, their next US entry will use that visa regardless of any other US visa in their passport. You don't get to choose which visa you use. So, if a K1 visa holder isn't ready to immigrate, they need to delay US entry until they ARE ready to immigrate.

A foreign fiance with an approved petition may not have a visa for several months. As such, they may wish to visit the US during the interim between NOA2 and visa issuance. This can be difficult and just how difficult will depend highly on the country.

The OP is not asking about any of what I just mentioned. He's asking about applying for and using a tourist visa during the K1 visa process. The chances of accomplishing this from Mexico are pretty slim primarily because doing so at any time is pretty difficult from Mexico, particularly if it's the first time requesting a visa.

so pushbrk you seem pretty knowledgeable, do you think i should tell my fiance not to come to visit me from Japan or not? I really don't want her to waste her time coming if she is going to be turnedright back around again. I think we should definetly have our noa2 by then. Do you think it is too much of a risk?

This is why it's bad to hijack threads. Japan is not Mexico and whether you fiance would be turned around or not would depend on the normal things like ties to home. If you want to discuss your fiancee's situation, do it in a thread devoted to it rather than confusing issues in this one.
