K1 visa denied, 221(g) issued

Definitely agreed that this person needs legal counsel. None of us are lawyers here; if we were, we'd be charging. From what I have seen when they questioned the bona fides of a K1, marrying and filing an I-130 usually remedied the problem. In what situations have you seen it cause a problem emt?

This is an article posted prominently on Family Based Immigration by an attorney who apparently specializes in these cases. . . the WHOLE article is pertinent to this case, but go to the heading "Lawyers--Be Careful here" and "A Rude Awakening. . ." (about 1/2 to 3/4 down the page) and you will find the specific answer to your question.

It does not happen every time, but often enough to cause BAD problems. . .

Hi all, my fiancee had her interview today and she was issued a 221(g). The interesting part is that they told her she cannot file for a waiver (I-601) unless she gets married to me. Has any of you heard that before? I'm lost for words and I don't know what to do now. Please let me know if you have any suggestions.

I am new in this forum, but I know a lot from other forums about this kind of situation.

Ma case is the same...frustrating and very tiring. Self contradictory arguments between USCIS and DOS, and their clash causes lots of unhappiness among the people like us.

My fiance filed I_129F for me. It was completed quick and I had my interveiw on April 1, 2008. I was denied undder 221(g).

We filed FIOA, asked Senator to help and we got the same answer the case was forwarded for "review" ... We inteded to get married anyway and after this terrible and unjust denial, he came in my country for the 3 rd time and we married.

We filed the new petition and it got approved quick enough. Now I am waiting for the interview again...

All I want to say is that waiting from USCIS to review I-129 F will take forever. It happens very seldom that USCIS ever reviews this kid of petition.

So according to my personal experience you can refile the new petition... Hopefully you will be lucky this time...

I really don't know what to expect this time. I have all kind of proof and had previously as well. My husband registered to the DOS webiste, he visited embassy many times and they know that he was in my country.

We still don"t know why I was denied. Probably Con thought it was fraud ( she denied me for tourist visas as well. 214(B) )

So here is my story.

And I hope that once the marriage is true and genuine soon or later our truth will win and moreover USA will change the law to make US citizens ' lives better without so much torture...
