White paper

Hi everyone,

My fiance has been denied and got white paper, I went up at 1:30 to ask why they refused her, they said they can't help me I have to wait until they send the package back to NVC than I can appeal. I tried anything and even a Visa agency help her to get ready. She said the interviewer given white to K-3 with kids even, they ask 3 question in Chinese and they just check few documents and gave her white paper. She is very upset and I will go back tomorrow before my flight to talk to them again, I know is useless, but I have to try.

If you guys have any suggestion let me know.

It would be helpful to know what the white paper gives as a reason. The only course of action that can help you now is to hire a local attorney experienced in working with the Consulate in Guangzhou. Do so immediately, so the case remains at the Consulate.

There are a number of attorney's offices in the Consulate building. One well known but rather expensive attorney officed there is Peter Paget.

Not sure why the CFL folks would recommend an appeal. In my experience, USCIS just lets the approval expire without ruling on anything. You then start over and hope to deal with the issues the second time around.

Hi,

No. They did not give any reasons to me just wait until we send the documents back to CIS they would contact you, according to last response CSI would let our K-1 expired.

They don't answer you just they say nothing to you.

I don't have a phone number. Your white paper states a reason for the intention to return the case with a recommendation to revoke. What is the reason given on the white paper?

I went back to consulate yesterday and actually beg someone to talk to me, i talk to someone from different section of consulate at least he talk to me, he told me you better apply again the appeal take more than apply a new K-1 visa.

He told me all the documents that i have like e-mails, phone calls, post card and all that show on going relationship, everyone can buy in China streets and Consulate assume our documents are froud and they will deny most of applicate to see if they continued follow up or If it's a scam they don't pursue any more.

Write a notarized letter to USCIS having your petition canceled and start over. That's what I did.

You have to find out why she was denied and correct whatever it was with the first petiton or you may end up in the same boat. I corrected ours by doing a K3 and got LOTS more evidence of a bona fide relationship. No problems the second time.

agreed that you have to cancel the first petition, or it will be denied "with prejudice" that will make a second petition more difficult to have success with.

there is something more to this story, it seems. the denial is not routine. it was for a reason. figure out what that reason is before you try again.
