fiancé(e) petition approval notice

Timeline

My fiance has entered the country and we have married.

In filling out the form for AOS it asks for a copy of the K-1 approval notice,

This was left in Brazil, she has the Visa and is in the USA is this copy absolutely necessary for AOS?

I did no think we needed all the documents since she had her Visa.

Any help appriciated.

I don't recall them asking for that. I remember just sending along a copy of the Visa.

If in doubt, have someone fax you a copy of it now so you can file AOS and snail mail you the original too.

Jomo's girl, they do require it. They also charge you a lot of $$ if you need a replacement. Have someone from home mail you it.

Timeline

AOS

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

I will complete the paperwork and submit it.

Will have the other documents sent here from Brazil in the meantime.

If they ask for it, when I recieve it will qail it to them.

Seems rather silly though, she has the Visa, has been admitted to the U.S., now they want a copy of their own papers which were required to receive the Visa in the first place, beuraucracy at its finest.

I agree, its a complete load of #######. Just get a fax of the original and submit that for now. Just make sure you have the original if asked for it.

Yes, you need to send in a COPY of the NOA2, the I-129F approval notice.

From I-485 instructions (page 4):

B. Based on admission as the K-1 fiancé(e) of a U. S.

citizen and subsequent marriage to that citizen.

Attach a copy of the fiancé(e) petition approval

notice, a copy of your marriage certificate, and your

Form I-94.
