Hi,

My wife's I-751 is pending and we are waiting for notice of interview or card.

I'm wondering if anyone is aware of the chances of having an I-751 interview or getting the card without the interview.

We did not have an interview to receive the 2 yr. GC, they just sent it to her. Does this mean that we won't have a removal of status interview?

One of the reasons I ask is because we're planning an x-mas vacation of a month. We'll be getting a I551 stamp, but, if they want want us to come in for an interview and the letter comes while we're away, that will not be good.

Advice??

22 Jul 2004-- Fiancee receives interview letter. Date is set to 08 September 2004. That's 6 months almost to the day of sending 129f!

08 Sep 2004-- K1 Embassy Interview is successful!!!

12 Sep 2004-- POE at JFK, no problems, temp work permit issued!

13 Sep 2004-- Applied for SS card.

23 Sep 2004-- Receive SS card

06 Nov 2004-- Married!

AOS/EAD

10 Feb 2005--Overnighted AOS/EAD package to Chicago center

06 Mar 2005--Rec's AOs/EAD NOA (must make Bio appt.)

08 Mar 2005--Biometrics Appt set for Apr 17

17 Apr 2005--Was fingerprinted and pictures were taken, took less than an hour. EAD will arrive within 90 days.

19 Apr 2005--Online Approval of EAD, says it will arrive as soon as card is ready--whatever that means...

25 Apr 2005--Online notice that AOS process is now continuing due to Biometrics being complete

The majority of cases are approved without an interview. You may wish to have someone monitor your mail and if you receive anything from USCIS while you are away, they are to open it and advise you of its contents. If it is an interview date, then you can decide them how to handle it. As well, you don't say when you sent in your I-751 to Vermont. Vermont is currently processing applications submitted December 2007. If your application was submitted around that time you may still hear something before your holidays. Generally, notices for interviews have had more than a month lead time so either way you are probably going to be alright.

Thank you for the reply.

We submitted in Nov 2007, so we should get something hopefully any time now. I'm working with my Senator to see why they haven't sent us anything yet.

Good info on the lead time (just in case.)

in majority, the only I-751 petitions that get called for interviews are the ones that are filed based on divorce (not joint petitions) and the ones that dont have sufficient documentation, so u should be fine

2004: I-485 Filed

2005: Interview & Conditional GC recv'd

05/2007: I-751 sent to TSC

06/2007: FP completed

05/25/2008: Recv'd letter that interview for 05/08 is being cancelled though I never recv'd a letter that interview was scheduled

06/2008: Cond'l GC 1yr extension expires 07/08, via info pass received a stamp in passport for another year

07/2008: recv'd interview notice for beginning of Aug

08/06/2008: I-751 interview and GC Apprv'l

08/20/2008: Physical GC Recv'd

05/2012: Eligible For Citizenship

hmm, not sure if those get called in for interviews.. they usually just ask you to send in more documentation..

they also do some interviews for for quality control..

hmm, not sure if those get called in for interviews.. they usually just ask you to send in more documentation..

they also do some interviews for for quality control..

it all depends .... there is no guarantee either way

If I could just piggy-back on this thread with a related question...

We just mailed our I-751 package yesterday and will be away the week of Thanksgiving, and probably for a longer period next June to visit Nepal again. I am getting started on my worrying early and have two questions:

Is there any given time in the next year that they are more likely to send an RFE than any other? IOW, is it more common just after they receive the package, or when they're getting ready to process it (like months from now), or anytime in between, with no discernable pattern?

How much time is usually given to respond to an RFE?

Fingers crossed that we don't get one!!

Not all interviews are because of insufficient evidence and divorce. You can be randomly selected for an interview just like we have been . We are not divorced and sent a ton of evidence spanning financial and personal information over 100 pages in all. I guess its just luck of the draw sometimes!

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

I got my RFE 11 months after I applied for I-751. From what I've read on the forum, they do the RFE thing when they're processing your case, not when they receive your application/package. They give you almost a month to respond, for example my RFE had Oct.17 as the notice date ( it was sent on Oct. 20 and I received it on Oct. 27) and I have to submit the "evidence" by Nov. 19.

Right now approvals are taking like 10 or 11 months Vermont Center and 3 or 4 months California Center so take that into consideration for your trip, hopefully you won't get an RFE, but if you do make sure you'll be here to send the papers in the requested timeframe.

Also take in consideration your next biometrics date for the trip your taking on Thanksgiving. I don't think you'll get your appoinment during that week but you never know. Usually the biometrics appoinment is like 4 or 5 weeks after you sent you package.
