Ok,,Husband and I wed October 11, 2008...

After much discussion and searching and research...we finally figured out that we should file a CR-1

I understand the CR-1 includes the multiple G325a and an 1-130..BUT...Do we still need to file an I-129f??

Can someone tell me EXACTLY what forms we have to send in because the more I read the more confused I become!!!

It depends if you want to submit 129-f. If you submit 129-f then that would be called as K3. K3 is for married couple also but if you come to USA in this type of Visa, you will need to apply for adjustment of status and all those stuffs just like in fiancé visa (K1). CR1 is an immigrant visa.

You can submit 129-f after you get a NOA1. You dont need to pay anything anymore since K3 is free if you filed for I-130.

yup that helps...so our intent is to file an immigrant visa..a CR-1... so only the two form and then we wait to be touched and sent the second package....

Congratulations on your marriage. Both my brother and I did Thanksgiving weekend weddings too (mine was US Thanksgiving weekend, but still :D).

If you've definitely decided on the CR-1 visa then there is no need to file an I-129f, as doing so would put you on the K-3 visa path which it sounds like you've already decided against. All that you need to submit at this time is the I-130 and supporting documents with a G-325A for each of you. NVC is where you'll have a bit more paperwork to keep on top of, but you've got time to learn all of that...

Smart move just going with the CR-1. Once your service center approves the I-130 it will be sent to NVC where you'll submit additional documents

After that to yopur embassy for an interview.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

i know ther eis a lot of waiting involved and this will most likely take longer than either of us want...but.....one more question

i can still enter the US to visit as long as i have strong ties to Canada right?? I have plans to go there for Thanksgiving and then again in January....

hello.. as i read your response here..i got an interest cuz i got married too last october 23,2008.We didnt file first cuz we need to comply first the document needed.But its really bother me about the address.What address shall i write in the form I-130?My parents address where I really live or the address we used in the marriage certificate?....this is the story....before my hubby came here in the philippines we plan to stay in the city cuz of the terrorism cuz i live in the province for the sake of his safety we did.Then, when we filed to the municipality...the incharge didnt allow us to file thier cuz we just only stay for one month..it should be 6 months and we need to go to my province.If we were go thier ....it takes to loong and that might be the wedding date will be postpone/delayed.Since,I have my aunte work in the city,,we used here address and the incharge allow us...and now my problem comes up whats the address should i write?

pls.help me to this....i'm really confused of it..

For most Canadians traveling to the US while in the process of immigration is ok. Just bring some strong ties in case the border officer questions you (ex: letter from employer stating you still have a job and date you're expected to return to work. bank accounts are still open, mortgage, rent, utility bills).

Most officers don't ask, but some do. Just be prepared. :thumbs:

Alright... :innocent: I vaguely understand the question but this is something that I can advise.

In G325a and I-130 forms, you will be asked for your present address until the oldest address you used. In I-130 you will be asked for the present address of which you live together. So basically, just put the real deal of your address there.

You will also have to put the date and place of marriage on both forms in G325a and I-130. But you just have to be honest about your addresses.

If you will clearly state your question you might get straight answers you are looking.

Wherever you lived together the last time, let it be any hotel address, you don't have to give out any proofs of where you lived, just its a basic question.

It is required of CR-1 visa to have lived together after marriage (some people do proxy marriage, but they need to consumate their marriage after the wedding), that's the reason why that last address is being asked.

this is getting easier i have to admit...asking the 'right' questions sure helps!!

I am not aware of any requirement to have lived together to qualify for CR1 - a little hard to do if you marry and then return to Canada. That was the case with us - when I filled in the I130, I put "NONE" in the line asking for our last address at which we lived together since there was none. I don't consider numerous weekends and vacations together over 10 years as living together; but it does provide plenty of evidence to verify the validity of the relationship when you get to that point in the process. I would have been a bit hesitant to put a random address down because there would be no way to verify it, if by chance they did ask. I think it would be obvious from your date of marriage and application date that you would not be living together. Of course things never seem to be straightforward with this process. Good luck.
