I have Questions on my AOS hopefully I can find what I want on these forums.

My question is I am a US citizen now and I have filed I 130 for my Husband who is in Pakistan. My I 130 is approved now. I have also send AOS fee online today. My question is about Affidavit of support I am dependent on my father’s tax return, in his tax return there are 5 people as dependent. My father earns about 15000 per year. I also have a sister who is a green card holder and married to a man in Pakistan, for my sister's I 130 case my brother who is single on his tax return, filed affidavit of support as a joint sponsor this June 2008. He earned about 23000 per year and has a good stable job. 1) My question is can he become a joint sponsor for my case also??? Even though he has filed for my sisters case??? Or I should find another joint sponsor for my case???? We have relatives who could have helped us for my sister’s case but they said No :unsure: for her. And now its my turn I don't know if I am able to find another sponsor other than my brother :help: and 2)because I’m a dependent on my fathers tax return should I show my father tax return or obtain some sort of proof from IRS that I cant file a tax return??? plz help

Salam!

AOS matter is very sensitive you wil have to be very carefull abt it.If you are dependent on ur father then u cannot sponsor ur husband then incase ur father will have to sponsor him.

But for this you will have to keep in mind the house hold size mean how many dependents in ur father's tax returns.

According to your case your house hold become 6+ your husband it means 7.

The requirements of 7 house hold size is 40000$/Year so you can see the difference.If your father has any asset then he can add this in AOS.

Your brother or any relative who is already sponsoring anyone cannot sponsor your husband.

And as far as yourself concerned there is new rule regarding tax returns that if you dont earn then you have to file 0 return file, Govt. will give you fund.You wil have to fill I 864 if you earn or not.

Now i tell u my experience my wife is alse US citizen she lives with her mother my wife doesnot work but this year she filed her tax return,shes on social security coz shes sick as well.

My wife filled I 864 and my mother in law filled 1 864A.

I can guide you regarding this coz US embassy in isalamabad has approved our AOS.My interview date is 10th Novemebr.

And i m on IR1 visa now.
