hi everyone,my fiance send our papers last oct 2, 2008 and already receive the tracking number from the office..i am pregnant now for 4months and my due date will be on march 27,2009..just wanna ask question,what if our application will be approved a month before i give birth,what would be the best thing to do about that?or what if gave birth here in the philippines,can i bring our our baby with me?what are the things that we need to do so the baby can travel with me in US?i just wanna know the answer so we can be ready,i will really appreciate all the help..thank you so much.

The USC parent does a "Consular Report of Birth Abroad" and secures a US passport for the child.

If your baby is born before you travel and it wasn't listed on your I29F I don't believe you will be able to bring your baby with you. Chances are your not going to have your visa by then unless everything goes perfect which hardly ever happens. I think you need to have your fiance contact the processing center he filed with and find out what changes he needs to make on the I29F. We are 5 months into our process. We are approved and she just needs to take her physical and interview. Everything has gone pretty smooth for us but we're still looking at a total of about 7 months total to complete the process and get her visa.

Bearcat: The baby would have dual citizenship and could travel to america freely with passport, a friend of mine was born on a US base in the philippines and has dual citizenship (I don't think he has filipino ancestry, though I could be wrong about that). Being pregnant and close to due or just having had a baby will most likely affect any plans for travel, if you just had the child, there is at least some risk of complications caused by flying, especially if there was surgery involved (c-section etc) but possibly even if not, if you haven't had the baby, then there is hte possibility that flying could cause you to go into labor, either way you may have to get medical clearance of some kind to board the plane. Also it might take some time to get the documentation for the new born baby before travelling, I don't think it'd take long but you'd need it done before travelling.

You cannot list an unborn child on the I-129F. If the USC is the father, the child is entitled to US Citizenship and needs a US passport, not a visa. The USC petitioner needs to contact the Embassy in Manila regarding filing a Consular Report of Birth Abroad, and then be prepared to file it as soon as the baby is born.

I'm not in your situation so I don't really know any of the answers for certain, you'll need the birth abroad stuff already mentioned by someone else to indicate that the baby is a USC, and a passport for the baby? There may be a provision that children under a certain age do not need a passport but I'm not sure, that's about all I know. I've also seen reports by people that were pregnant during their medical and they still passed the medical but were not required to get the vaccinations (they'd have to get them before AOS though is what I understood). I only know what I read here so all my information is mostly second hand, and I tend to focus on the things that directly affect me which means I know very little about divorces, annulments, children and babies, born or not, etc.

From what I can make out, in order for your baby to be registered as a US Citizen, it will also need to be legitimated by the USC, as he is the father. The method (2 of 2) was determined by the birthdate of your baby falling after a certain year. The following was taken from this page on the US Embassy Manila site:

Legitimation Method 2 - The person can be legitimated if:

1.

the father (unless deceased) has agreed in writing to provide financial support

for the person until the person reaches the age of 18 years and,

2.

while the person is under the age of 18 years -

1. the person is legitimated under the law of the person's residence or domicile,

2.

the father acknowledges paternity of the person in writing under oath, or

3.

the paternity of the person is established by adjudication of a competent court.

You can then register the birth, as per the instructions and forms listed on this page of the same website.

Don't forget, you will need to provide evidence of the ability to meet 125% of the poverty level for a family of 3 and not 2. This is even if the baby isn't born at the time of interview.

As for the medical, you'd need to check with the examiner what will happen because you cannot have any live vaccines or undergo the xray for TB, if this is the procedure for your embassy. You would qualify for a waiver, on these grounds, I'm sure. But you would need to be able to prove you have received them in order to be able to process your AOS.

You can request to expedite your documents, ur status does qualify you for expedite due to the flight risk if u near to have a baby. Medical can also tell you if you cant fly or be able too!

As far as I've seen on here (and there have been a number of cases), USCIS won't expedite for pregnancy--you'll have to wait for approval from your center with the crowd. Being pregnant may help you get things moving more quickly once the case gets to your embassy, but there isn't much you guys can do now but wait.
