As you all know the economy is in trouble and my fiance has been in a financial dificulty.

I'm waiting for my interview still but have been aproved.

If he were to file for welfare for our daughter soon. Could I be denied my visa?

Would they be able to know? He has previous pay stubs up until 3 weeks ago. Could they know?

Please help!

Arianna, sorry to hear about your situation. Believe it or not, a lot of people are in that same position now and it's just sad to think how much it is impacting peoples lives.

I'm not an expert but what I've read indicates that accepting government assistance could impact the Consulates decision to grant the K-1 Visa if they were to find out during the interview. Family is always first priority, keep you daughter fed and healthy. If you don't have sufficient financial savings or equity, I would delay the interview until your finace is able to find secure employment that meets the minimum requirements.

The Daughter is in the US and is a USC, so I can think of no reason why an application can not be made.

The K1 and AoS is another issue, uou either need money/ capital or income.

PS I am asuming you are legally present in the US.

Yes, I came as a tourist and the POE officer gave me 6 months to stay. But I can't legally work so my hands are tied to help.

I am so sorry for your situation to put it bluntly it sucks

They will be able to tell your financial situation when you submit your affidavit of support

I know that you have stated that you do not have a co sponsor, the other option is to self sponsor or do you have enough assets to make up the short full.

I actually have a house back in Mexico that I am trying to sell. My mom is taking care of it, this house was left to me by my uncle. When I sell it I will be able to do what ever we need, but right now I'm a bit broke. I had sold a house and this money was invested in getting a car and rent and several other things. Long story short I spent all the money.

But the house getting sold and me actually seeing any of that money is probably 6 months minimum away from today. Paperwork takes a LOOOONG time to get through.

So we are kinda stuck.

He says we will worry about that later, that for the moment he's not letting his daughter starve or be homeless.

He says that they would not separate me from her, that US law always side with mother. So that if she is a US citizen that it will be very dificul to get denied.

I just don't know.

He is not correct. They will not waive this requirement just because your daughter is in the US. You may be able to file a hardship waiver, but it will not just happen. It always seems like its the men on here that think the US will just waive requirements for them ;) Don't let him learn the hard way. If I were you, I'd continue on with the K1 and try and delay the interview until your fiance picks up a 2nd job or something to show an increase in income. Also make sure to count all assets such as your house and savings he has etc. Time to get creative with your finances. Definitely make sure to prioritize your daughter's health and well-being as you can always try again once there is a turn around for your family.

What if he only uses this for about a month while he finds another job and pays debts? Could a short term asistance be held against him?

We are planning on moving to another state since where we are things are REALLY bad an where we are going we have a few friends and we hear work and living is better. This is in about a month.

So if he gets help for a month to get back on track and keep our child fed and under shelter. Do you think it will be held against us?

I'm probably not having my interview till late Dec or early Jan. So that should give us some time. Right?

On the I-134, it states that they want a letter from your fiance's employer stating date of employment salary and whether the position is permanent or temp. So I guess there might be a question about why the employment is so recent. Or I guess you could get one from his current employer and hope they don't ask why its not more recent. I think with a bit of creativity you should be able to get through this. I think it will just depend how closely the IO decides to look at the I-134.

hello to u.. my name is aishah and im new to vj site,, let me answer this question for ya,, ive ben doing alot of researching,the thing that the govermetn doesnt want is for the alien relative to become a public charge,the goverment definition of public charge is they dont want them to recieve anything of cash value like ssi,, or tanf.they can recieve food stamps,hud housing,medical card(as long as they are not in a place for long periods of time getting help like,drug rehab or nurseing home ecttt,)even they can get w.i.c.if the aliens sponor,say his wife in usa or her husband in usa is on any kind of public aid assistance other than tanf or ssi, its ok and cannot be held against them,

if u want to find out more information go to yahoo search and type in things like,, what is considerd a public charge for someone applying for visa,, or just words in this nature,, its how i found my information,, hope it helps ya.

Hello my friend I'm not sure where you are located or if this question has been answered in this way already but after reading your post i called my friend who works for the Los Angeles County Department of Social Services and she faxed me the following information which they give to new immigrants that apply for welfare or as she put it "public benifits". Again i dont know it this applies per say to your particular location if you are in another state other than CA but its probably a good general rule ill attach it as a scanned image to this post. Hope this helps. I think the key word is NON CASH benifits if you are awarded cash benifits this may affect your immigration status insofar as the USCIS is concerned because then you have become a "public charge"
