As you all know the economy is in trouble and my fiance has been in a financial dificulty.

I'm waiting for my interview still but have been aproved.

If he were to file for welfare for our daughter soon. Could I be denied my visa?

Would they be able to know? He has previous pay stubs up until 3 weeks ago. Could they know?

Please help!

I think the purpose of the I-134 Affidavit of Support and the 125% above poverty level is to make sure you don't need government support, which includes welfare, because in their mind is, if you can't take care of yourself why grant you the rights to bring more people into this country.

I don't know if they'll be able to tell about claiming welfare benefits, but one thought... Keep in mind that you'll have to file the I-184 to adjust status, which means they will probably look for more recent pay stubs. It might be a good idea to get a co-sponsor now.

If his income is sufficient for AOS (with you included in the household size), he may not qualify for welfare anyway.... i dont know, just a thought.

I think a co-sponsor is a good suggestion

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

We cannot get a sponsor.

And he was doing fine until this economic situation went down. He is in sales and obviously nobody is buying now. So we can't sit here an let our daughter starve or become homeless.

If I was alowed to work in the US by now, then we wouldn't have this problem.

We had the situation under control until the economy went bad on everyone. We had everything and then 3 weeks of no sales and we are in a bad sittion. Not fair!!! :ranting:

My daughter is a US citizen, I am in the US waitig for my interview.

I know that you have stated that you do not have a co sponsor, the other option is to self sponsor or do you have enough assets to make up the short full.

If your daughter is a US citizen he should be able to get assistance for her. It is worth checking into. Good luck and I hope you have a solution to your financial situation very soon.

The key here is survival. Immigration, families being together, and survival are 3 different things.

You shouldn't even consider the consequences of immigration, if it means jeopardizing your daughters health and safety.

We all have to make sacrifices, and if you absolutely can't get a co-sponsor, you may have to hold off for a bit regardless of welfare.

If there's no income and no assets, the chances of meeting the AOS guidelines is pretty slim.

Yes, the long-term health and safety of your daughter will be enabled by the family being together,

but it sounds like today she needs some basics like heat, water, and food.

I don't believe in welfare, but I also don't believe in children being hungry.

Put the immigration on hold, do what you have to so your daughter isn't hungry.

Best of luck on everything. Let's hope the economy picks up for all of us.

I actually have a house back in Mexico that I am trying to sell. My mom is taking care of it, this house was left to me by my uncle. When I sell it I will be able to do what ever we need, but right now I'm a bit broke. I had sold a house and this money was invested in getting a car and rent and several other things. Long story short I spent all the money.

But the house getting sold and me actually seeing any of that money is probably 6 months minimum away from today. Paperwork takes a LOOOONG time to get through.

So we are kinda stuck.

He says we will worry about that later, that for the moment he's not letting his daughter starve or be homeless.

He says that they would not separate me from her, that US law always side with mother. So that if she is a US citizen that it will be very dificul to get denied.

I just don't know.

I would look into self sponsoring then as you have assets in the house, I dont know how much your assets have to be worth to be able to do this, but it is an option.

I wish that I could give you advise but I am not in a position todo so, as I do not have the necessary knowledge to advise you, but I am sure that some members with more experience will be able to help you more.

If you have a house in Mexico...you can use that as an asset at a ratio of 5:1.

That is, if your house is worth $50K, you will get credit for $10K in determining AOS.

Yes, your daughter and husband being USC is a good thing,

and there's a possibility that you could prove that it would be a hardship if you were separated or if they had to move to Mexico.

It is possible, but it would be an exception. They don't side with mothers....they side with the law. But if you have a strong case,

you can win. Be optimistic, but also be realistic.

By all means, get the government financial assistance for which your daughter is eligible, including Medicaid. Worry about everything else later. Meanwhile, as the holiday season approaches, the retailers are hiring good salespeople.

Has your fiance thought of getting another job? Even with the economy in a slump there are plenty of jobs available, perhaps not what he likes doing, perhaps at a lower rate than he had been receiving, but a steady income nonetheless.

I think that should also be a priority. Even if he has not been fired or quit his former job, now might be a really good time to look for something else.

The Daughter is in the US and is a USC, so I can think of no reason why an application can not be made.

The K1 and AoS is another issue, uou either need money/ capital or income.

PS I am asuming you are legally present in the US.

I just don't know.

He is not correct. They will not waive this requirement just because your daughter is in the US. You may be able to file a hardship waiver, but it will not just happen. It always seems like its the men on here that think the US will just waive requirements for them ;) Don't let him learn the hard way. If I were you, I'd continue on with the K1 and try and delay the interview until your fiance picks up a 2nd job or something to show an increase in income. Also make sure to count all assets such as your house and savings he has etc. Time to get creative with your finances. Definitely make sure to prioritize your daughter's health and well-being as you can always try again once there is a turn around for your family.
